Maintain proposal to abolish death penalty for embezzlement, bribery, drug trafficking

On the afternoon of June 10, the National Assembly Standing Committee gave opinions on receiving, explaining, and revising the draft Law amending and supplementing a number of articles of the Penal Code (amended).

Deputy Minister of Public Security Le Quoc Hung said that in this amendment, the Government proposed to remove 8 crimes with the death penalty based on careful research and assessment of the issues.

These crimes include: embezzlement of property; bribery; illegal transportation of narcotics; activities aimed at overthrowing the people's government; espionage; sabotage of Vietnam's material and technical facilities; production and trade of counterfeit medicines and preventive medicines; sabotage of peace and waging wars of aggression.

Based on the nature and extent of the crime; the importance of the protected object; the ability to remedy the consequences caused by the crime.

Based on the results of the summary of the implementation of the Penal Code, many crimes have provisions for the death penalty but have not been applied in practice in recent times.

International experience shows that currently, the trend of reducing the death penalty in legal regulations as well as in practice in the world is common. Of the 193 countries that are members of the United Nations, only more than 50 countries have regulations on the death penalty.

Another basis is to serve our country's international cooperation activities, especially in the current context, when Vietnam is expanding international cooperation deeply in all areas of social life.

Building a legal system similar to the majority of countries in the world will contribute significantly to promoting increasingly strong cooperative relations and mutual trust.

The Deputy Minister of Public Security also stated that the form of execution of the death penalty in the world as well as in our country is moving towards becoming more humane.

From the forms of revenge, venting anger on criminals such as dismemberment, throwing into a cauldron of oil, throwing into a tiger cage, being torn apart by four horses... up to now, most countries do not apply these forms of death penalty. Our country has applied the form of death penalty considered the most humane, which is lethal injection.

From the above issues, the Government finds that the abolition of the death penalty for 8 crimes as in the draft law submitted to the 15th National Assembly at the 9th Session is appropriate in the current conditions of our country.

This not only meets the requirements of fighting and preventing crime, but also meets the process of continuing to reduce the death penalty, as well as the requirements of cooperation and expanding international relations for national development.

Particularly for the crimes of embezzlement and bribery, after abolishing the death penalty, in order to ensure the recovery of assets obtained from crimes, at the same time encourage criminals to actively report during the process of resolving cases.

The draft law has amended and supplemented the provision that a person sentenced to life imprisonment for embezzlement or bribery can only have his/her sentence reduced if he/she has actively returned at least three-quarters of the embezzled or bribed property and during the investigation, prosecution and trial period has actively cooperated with the authorities in detecting, investigating and handling the crime or has made great achievements.
