Speaking at the Conference, President of the City Lawyers Association Nguyen Thi Mai emphasized: The Constitution is the original law, the basic law with the highest legal effect, not only regulating core issues on the political regime, economy, culture, society, national defense and security, human rights, basic rights and obligations of citizens, but also the foundation of the entire legal system, the compass for all activities of the State and society.
The amendment and supplementation of a number of articles of the 2013 Constitution is a necessary and important step, aiming to concretize the spirit of the Party's resolutions and conclusions, especially Resolution No. 66-NQ/TW of the Politburo on innovation in law-making and enforcement. This is an urgent requirement to meet the task of national development in the new era; at the same time, it creates a constitutional basis for implementing the revolution of streamlining the organizational apparatus, building and perfecting a more effective and efficient political system, serving the goal of rapid and sustainable development and bringing the country to rise strongly in the new era.
At the Conference, delegates listened to Vice President of the City Lawyers Association Nguyen Dinh Quyet present the Draft Resolution on amending and supplementing a number of articles of the 2013 Constitution of the Socialist Republic of Vietnam.
Next, Vice President of the City Lawyers Association Nguyen Ha Son presented a comparison between the proposed amendments and supplements with the current regulations in the 2013 Constitution, in order to clarify new points and directions for adjustment in the process of building and perfecting the draft.
The majority of delegates attending the Conference expressed their high consensus and agreement with the Draft Resolution amending and supplementing a number of articles of the 2013 Constitution, and at the same time contributed a number of specific opinions. Regarding the two-level local government model, delegates assessed the provisions in Article 110 of the Draft in a general direction as reasonable, creating flexibility in the law. However, it was proposed to clarify Clause 1, Article 110 in the direction of specifically defining two administrative levels: provincial level and grassroots level; the names of grassroots administrative units will be prescribed by law. At the same time, it was recommended to soon amend the Law on Organization of Local Government with clear and scientific criteria for classification, establishment, and merger.
Regarding the functions and tasks of the Fatherland Front and socio-political organizations, it is recommended to clarify the concept, functions, monitoring mechanism, social criticism and responsibility for receiving and handling recommendations of state agencies. It is recommended that the right to question of People's Council delegates for judicial positions should not be removed; it is necessary to specify the mechanism of "chairing" and "unifying action", clearly stipulate the coordination regulations between the Vietnam Fatherland Front and its member organizations.
Regarding Article 2 of the Draft, delegates suggested that the transitional regulations must be comprehensive and feasible, ensuring the smooth operation of the political system and having little impact on people's lives. It is proposed to add a provision assigning the Government to guide implementation, and at the same time review and amend relevant legal documents with a specific deadline. Allowing non-People's Council delegates to hold leadership positions of the People's Council also needs to be carefully considered./.
