Implementing Joint Circular No. 01/2017 dated December 29, 2017 regulating the coordination between competent agencies in implementing a number of provisions of the 2015 Criminal Procedure Code on receiving and handling denunciations, crime reports, and recommendations for prosecution; Joint Circular No. 01/2021 dated November 29, 2021 of the Ministry of Public Security - Ministry of National Defense - Ministry of Finance - Ministry of Agriculture and Rural Development - Supreme People's Procuracy, People's Procuracies at 2 levels in the province coordinate with competent prosecution agencies to receive and classify 3,405 sources of crime information; accept 3,260 information; recommend prosecution and timely resolution of 2,930 information; participate in supervising the examination of 1,195 cases; Checked and verified 2,788 reports and recommended prosecution, reaching 93.12%; extended the processing time for 254 reports...
At the conference, delegates discussed and assessed the difficulties and obstacles in the implementation of the circulars. Accordingly, the main obstacles were related to the implementation of some provisions of the Penal Code and the Criminal Procedure Code that have not been specified or have specific instructions; the police are slow to transfer files to the district-level investigation agency, causing difficulties in the inspection, verification, and collection of documents and grounds for handling information about crimes in the area. The coordination between the investigation agency and the same-level procuracy in implementing some articles of the Criminal Procedure Code on the management and handling of temporarily suspended cases and incidents has been suspended. Some legal provisions related to the reception and handling of information about crimes are not complete and clear; the reception and handling of denunciations and reports of crimes are not timely; the coordination between relevant agencies in receiving and handling information about crimes is not close...
Speaking at the conference, comrade Le Minh Long, Director of Department 2, Supreme People's Procuracy requested the provincial People's Procuracy 2 to continue to thoroughly grasp and strictly implement the provisions of the Criminal Procedure Code, Joint Circular No. 01/2017, Joint Circular No. 01/2021 and legal documents related to the handling of crime reports and denunciations. Do a good job of inspection, assign prosecutors and officers to regularly grasp and strictly manage crime reports and denunciations; grasp sources of crime information; closely supervise the organization of grasping, verifying, classifying and handling crime reports and denunciations to ensure timeliness, objectivity, comprehensiveness and thoroughness.
Do not let the situation of overdue reports, baseless classification and settlement, wrongful prosecution, and errors of prosecutors happen. Organize training, improve skills and expertise for officials and prosecutors on the practice of the right to prosecute and supervise the reception and settlement of denunciations, reports of crimes and recommendations for prosecution. Periodically summarize and draw lessons from good practices and good experiences to disseminate and promote the effectiveness of the work, especially in the organization, implementation and enforcement of Joint Circular No. 01/2017 and Joint Circular No. 01/2021.
