Overcoming shortcomings in mineral management and licensing, resolving the shortage of construction materials

Overcoming shortcomings in mineral management and licensing, resolving the shortage of construction materials

On July 29, 2025, Permanent Vice Chairman of the Provincial People's Committee Nguyen Van Thi signed Decision No. 2595/QD-UBND promulgating the Plan to overcome shortcomings and limitations in the management and licensing of mineral activities to solve the shortage of construction materials in Thanh Hoa province. The Decision takes effect from the date of signing.

Currently, in Thanh Hoa province, there are 349 mineral mines with valid mining licenses. Of these, 17 mines are licensed by the Ministry of Agriculture and Environment (formerly the Ministry of Natural Resources and Environment), mainly mines exploited for cement production; 332 mines are licensed by the Provincial People's Committee, mainly mines of soil, stone, and sand for common construction materials.

However, through review, it is shown that the exploitation capacity of new stone mines only meets about 73.2%, new soil only meets about 16.7%, and sand only meets about 1.84% of market demand, leading to a shortage of construction materials and filling materials to serve the needs of infrastructure construction in the province, causing congestion and hindering the socio -economic development of the province.

The causes leading to the above situation are determined to be that the mineral mines are being inspected, examined, investigated by competent authorities and have been suspended from exploitation due to violations; have exploited all reserves and permitted exploitation capacity; have not signed land lease contracts or gathering yards; have not cleared the site; the means of exploitation and transportation have not been registered or inspected...

Implementing the direction of the Provincial Party Standing Committee in Notice No. 628-TB/VPTU dated June 12, 2025 and Notice No. 637-TB/VPTU dated July 22, 2025, the Chairman of the Provincial People's Committee issued a Plan to implement a number of key tasks to thoroughly resolve existing problems, limitations, and obstacles to soon put material mines into stable exploitation, meeting the needs of economic and social development of the province.

Regarding specific solutions, the Chairman of the Provincial People's Committee assigned the Department of Agriculture and Environment to preside over and coordinate with the Provincial Police, relevant sectors and units to urgently coordinate with owners of mineral mines (soil, stone, sand) that are operating and meet the prescribed conditions to increase mining capacity, promptly complete the dossier to adjust the capacity increase to increase the supply of construction materials in the province; report to the Chairman of the Provincial People's Committee before August 10, 2025.

Urge units that have won the auction for mineral exploitation rights but have not yet been granted an exploitation license to promptly complete related procedures to be granted an exploitation license, lease land and put the mine into operation; proactively reduce the time for reviewing administrative procedures according to the "green lane" priority mechanism in Official Dispatch No. 11362/UBND-THDT dated July 17, 2025 of the Chairman of the Provincial People's Committee; report to the Chairman of the Provincial People's Committee on the implementation results before August 15, 2025.

Preside over and coordinate with the Department of Construction, relevant departments, branches, units, People's Committees of communes and wards, urgently review the mining areas already included in the mineral planning, ensure that they do not overlap with other plans to update the plan for auctioning mineral exploitation rights, submit to the Provincial People's Committee to report to the Provincial Party Standing Committee for comments as a basis for implementing the auction and granting mining licenses to meet the material sources for use in the province. For mining areas that overlap with other plans, review, update, remove from the planning or adjust during the implementation of the task of preparing and approving the geological and mineral management plan. Completion date before August 20, 2025.

Preside over and coordinate with the Provincial Police, the Department of Justice, and the tax authority to assess and propose to mines that show signs of violations due to lack of understanding of the law, with a simple nature and level that is not yet serious enough to consider criminal liability, advise the Chairman of the Provincial People's Committee to handle administrative violations according to regulations; at the same time, request units to remedy the situation; report to the Chairman of the Provincial People's Committee on the implementation results before August 20, 2025.

Review licensed mines that have recovered block stones for cutting to make paving stones, fine art stones, etc., and recover minerals to make cement additives; mines with terrain deviations to report to the Provincial People's Committee for approval to adjust reserves, adjust mining licenses or reissue mineral mining licenses in accordance with regulations, avoiding loss of state budget revenue; report to the Chairman of the Provincial People's Committee on implementation results before August 30, 2025.

Preside over and coordinate with the Department of Construction and related sectors, units and localities to organize a comprehensive review and assessment of the remaining reserves of licensed, valid and exploited sand mines; at the same time, survey and assess mineral reserves in areas outside the licensed boundaries of sand mines (within a radius of 500m from the boundary of the mine area), as a basis for monitoring and supervising mineral exploitation activities of units; completion time in 2025.

For mines related to cases being investigated by competent authorities, as soon as the investigation conclusion is available, the Department of Agriculture and Environment shall advise the Chairman of the Provincial People's Committee to consider and handle them according to the provisions of law.

The provincial police coordinate with relevant departments and branches to effectively implement the contents of the Plan. Inspect, verify, and strictly handle social subjects hiding under the guise of enterprises to manipulate the mineral market and mine owners who deliberately violate tax obligations, commit very serious violations in mineral exploitation activities, causing loss of state budget revenue.

The Department of Finance, the Management Board of Nghi Son Economic Zone and Industrial Parks shall preside over and coordinate with relevant sectors and units to urgently advise the Chairman of the Provincial People's Committee to consider and approve investment policies for auctioned mines that meet the conditions, as a basis for units to complete procedures for granting mining licenses and land leases, and soon put the mines into operation.

The Department of Finance shall preside over and coordinate with relevant sectors and units to advise the Provincial People's Committee to supplement the regulations on the tax calculation price frame for the group of "block stones for cutting after mining without color and quality classification", as a basis for determining the fee for granting mineral exploitation rights for the group of block stones for paving stones and fine art stones according to regulations.

The Department of Construction shall review 557 mineral mines in the Provincial Planning according to the direction in Notice No. 73/TB-UBND dated May 15, 2025 of the Chairman of the Provincial People's Committee; if there is an overlap with other planning and the conditions for continuing the planning are not met, propose not to continue the planning, and at the same time synthesize and send to the Department of Agriculture and Environment for updating, removing from the planning or adjusting during the process of performing the task of preparing and approving the management plan on geology and minerals; report to the Chairman of the Provincial People's Committee on the implementation results before August 15, 2025.

Preside over and coordinate with relevant sectors, units, Project Management Boards, People's Committees of communes and wards to review construction investment projects in the province that are capable of recovering minerals for common construction materials (stone for common construction materials, fill soil, sand) during the construction process of leveling the ground, dredging and clearing waterways; send to the Department of Agriculture and Environment to guide investors to register for mineral recovery according to regulations to supplement the supply of construction materials for project works in the area.

Preside over and coordinate with relevant units to promptly announce construction material price information in accordance with declared prices, selling prices at material mines and market prices.

Inspection Sub-Department No. 12 shall preside over, coordinate, support and guide sand mine owners to promptly complete registration and inspection procedures for sand suction vehicles according to regulations to soon put the mines into operation; regularly implement and periodically report to the Provincial People's Committee (through the Department of Agriculture and Environment) on the 25th of each month.

Thanh Hoa Provincial Tax Department shall preside over and coordinate with the Department of Agriculture and Environment and the Provincial Police to issue documents guiding enterprises to declare additional taxes on mineral exploitation and trading activities in the province; complete and report the implementation results to the Chairman of the Provincial People's Committee before August 30, 2025.

People's Committees of communes and wards: For mines that have mining licenses but do not have land lease decisions for mining areas, mining sites, and staging areas: Urgently review and supplement the planning and land use plans at the commune level according to regulations; promptly establish a Compensation, Support, and Resettlement Council to organize site clearance; issue decisions on land allocation and land lease according to authority so that enterprises can soon complete procedures to start operations; implement regularly and periodically report to the Department of Agriculture and Environment on the 25th of each month.

Review mines that are having difficulties in site clearance, clearly identify the causes and reasons to guide and support units to complete land lease procedures to put the mines into operation soon; report to the Department of Agriculture and Environment before August 15, 2025.

Review areas with minerals for common construction materials (filling soil, stone, sand) that meet traffic and environmental conditions... report to the Department of Agriculture and Environment for updating in the "Geological and mineral management plan", and update in the planning and land use plan when the planning period comes as a basis for granting mining licenses to serve the material needs in the province.

For enterprises that are owners of mineral mines , proactively declare additional information on the volume of minerals that have been exploited but not yet declared; proactively correct violations during mineral operations. To be completed before August 20, 2025.

Strictly and correctly implement the provisions of the law on minerals, land, environment and related laws during mineral activities.

Actively coordinate with authorities to promptly resolve difficulties and problems so that businesses can operate effectively, serving the economic and social development of the province.
