Completely overcome the situation of "law waiting for decree..."

The situation of slow issuance of documents detailing laws, ordinances and resolutions that have come into effect has not been completely resolved. As of the end of September 2025, there were still 55 laws, ordinances and resolutions of the National Assembly that had come into effect but had no detailed regulations.

This is the information pointed out by the Economic and Financial Committee in the Report on the review and assessment of the implementation results of the National Assembly's Resolution on the 2025 Socio-Economic Development Plan and the projected 2026 Socio-Economic Development Plan.

In recent times, the Party, the National Assembly and the Government have paid special attention to the work of institutional and legal development. In particular, attention has been paid to removing institutional bottlenecks, simplifying procedures, reducing intermediary levels, reducing costs and time for people and businesses. Many important resolutions such as Resolution No. 57-NQ/TW, Resolution No. 59-NQ/TW, Resolution No. 66-NQ/TW, Resolution No. 68-NQ/TW of the Politburo have been issued. Based on the Party's resolutions, the National Assembly has issued many laws and resolutions to promptly remove institutional obstacles and pave the way for economic and social development.

In addition to the achievements, it is also frankly acknowledged that the work of law-making still has limitations and shortcomings. Among them, there is a situation of slow issuance of detailed regulations. It is worth mentioning that, although mentioned in many sessions of the National Assembly , meetings of the National Assembly Standing Committee, and in many specialized sessions of the Government on law-making, the situation of slow issuance of detailed regulations still occurs.

The delay in issuing guiding documents has inadvertently created a legal gap, making the organization of implementation encounter many difficulties. People, businesses and enforcement agencies are all confused in applying and enforcing the law. This affects the rights and obligations of people and businesses. This is also one of the reasons why the provisions of the law and resolutions are slow to come into life.

The question is, why have laws and resolutions that have been passed, especially those passed by the National Assembly at the 9th Session of the 15th National Assembly, not yet been issued detailed regulations? Voters and people expect the Government to clarify the reasons for the delay in issuing these 55 detailed regulations. Along with that, the Government should specifically assess how the delay in issuing detailed documents will cause difficulties for law enforcement? What is an effective solution to overcome the debt of these guiding documents?

Resolution No. 67/2013/QH13 of the National Assembly on strengthening the implementation of laws, ordinances, resolutions of the National Assembly and promulgating detailed regulations and guidance documents for implementation, clearly stated that the Government, the Prime Minister, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy and relevant agencies and organizations regularly urge the organization of inspections and checks on implementation; promptly detect and clarify the causes; self-examine and assess their responsibilities when they have not completed their tasks in organizing the implementation of laws and promulgating detailed regulations and guidance documents for implementation. At the same time, consider handling the responsibilities of the heads of subordinate agencies for delays in implementing and promulgating detailed regulations and guidance documents for implementation; identify this as an important criterion to assess the level of task completion of the heads of agencies.

The National Assembly Resolution clearly stated the need to consider the responsibility of competent agencies and individuals for the delay in issuing detailed regulations. Therefore, relevant entities need to comply with these requirements.

It must be affirmed that the development and improvement of laws has been strongly implemented in recent times and is highly expected to create a complete and favorable legal framework for people and businesses. However, this will not be enough if the guidance and implementation of laws are not timely and effective. Therefore, in order for laws, ordinances and resolutions to come into life and become a lever for socio-economic breakthroughs, we need strict sanctions for cases of delay or debt of detailed regulations and guidance documents due to subjective reasons. Avoid the situation of delay or debt of detailed regulations and guidance documents that recurs every year, but it is still difficult to handle responsibility.
