Unblocking bottlenecks, promoting decentralization and delegation of power, creating momentum for Hai Phong to develop even more strongly

The issuance of the draft Resolution of the National Assembly replacing Resolution No. 35/2021/QH15 on piloting a number of specific mechanisms and policies for the development of Hai Phong City is extremely necessary to clear the "bottlenecks", create breakthroughs, have great spillover effects in the Red River Delta region and contribute more to the economic growth rate of the whole country. This is the opinion of the members of the National Assembly Standing Committee when giving opinions on this content at the 44th Session.

Pilot green economy projects

Many opinions at the meeting agreed that the draft Resolution of the National Assembly replacing Resolution No. 35/2021/QH15 on piloting a number of specific mechanisms and policies for the development of Hai Phong City, if approved at the upcoming Ninth Session and taking effect immediately, will help Hai Phong deploy more quickly and develop more strongly.

However, because the draft Resolution is being considered in the context of implementing the policy of merging provinces, some opinions suggest that attention should be paid to this issue.
Chairman of the Law and Justice Committee Hoang Thanh Tung stated that the Government's Proposal has not mentioned how this Resolution will be applied when Hai Phong implements the merger and expansion of its area. Therefore, the Government needs to soon seek the opinion of the Politburo as suggested by National Assembly Chairman Tran Thanh Man.

The Draft Resolution on piloting a number of specific mechanisms and policies for the development of Hai Phong City expands the scope of decentralization and delegation of power in accordance with the direction of the Politburo and the spirit repeatedly emphasized by General Secretary To Lam: "locality decides, locality acts, locality takes responsibility"; the Central, the National Assembly, and the Government create and supervise. However, it is recommended to continue decentralization and delegation of power more strongly, especially since the draft Resolution was previously developed in the context of no direction for merging administrative units and no direction for decentralization and delegation of power. It is noteworthy that the development of the Resolution on piloting a number of specific mechanisms and policies for the development of Hai Phong City, if based only on Resolution No. 45-NQ/TW and Conclusion No. 96-KL/TW, is not as new as the Resolution of the 10th Central Conference and the Resolution of the 11th Central Conference of the 13th tenure. Therefore, it is necessary to continue updating the Politburo's decisions and policies.

Regarding policy groups, specifically financial mechanisms, National Assembly Chairman Tran Thanh Man emphasized that incentives must be more favorable than the current regulations. According to Resolution No. 35/2021/QH15, Hai Phong is allowed to keep no more than 70% of the increase in central budget revenue in the area for infrastructure investment. The draft Resolution proposes to increase it to 80 - 85%. The National Assembly Chairman believes that this is a reasonable proposal.

In particular, the National Assembly Chairman said that Hai Phong needs to take the lead in applying technology and digital transformation; continue to institutionalize and apply Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science, technology, innovation and national digital transformation, Resolution No. 193/2025/QH15 of the National Assembly on piloting a number of special mechanisms and policies to create breakthroughs in science, technology, innovation and national digital transformation, and laws on science and technology into Hai Phong's development.

The National Assembly Chairman also suggested that the draft Resolution should emphasize that streamlining the apparatus and administrative reform will determine the development of Hai Phong in the coming time; at the same time, it is necessary to focus on environmental protection, sustainable development, and stricter environmental impact assessment regulations for sea encroachment projects, industrial parks, and urbanization; pilot green economic projects, such as sustainable aquaculture, eco-tourism, and the use of renewable energy in industrial parks.

Note that "the drafting of the Resolution needs to closely follow the process of amending relevant laws, similar contents do not need to be specified in the draft Resolution", Chairman of the Law and Justice Committee Hoang Thanh Tung cited, in Article 5, the draft Resolution stipulates that Hai Phong is allowed to borrow through the issuance of local government bonds, borrow from domestic financial institutions, other domestic organizations and from foreign loans of the Government to the city with the total outstanding loan balance not exceeding 120% of the city's budget revenue according to decentralization... However, this is also a provision in the draft Law on State Budget (amended).

Similar to the personal income tax and corporate income tax exemption policies in Article 7 of the draft Resolution, the Chairman of the Law and Justice Committee suggested that the drafting agency review Resolution No. 193/2025/QH15 of the National Assembly, which has provisions on personal income tax incentives for scientists and experts, and the draft Law on Science and Technology (amended) also consider amending policies related to corporate income tax.

Ensure clarity and transparency in application

Recently, the disbursement of public investment capital for projects has been slow, mainly due to problems with land acquisition, compensation, support, and resettlement. Raising this issue, Vice Chairman of the National Assembly Vu Hong Thanh said that it is necessary to create a mechanism for Hai Phong. And in the acquisition of interleaved land, it is necessary to clarify the criteria for interleaved land to avoid taking advantage of the policy.

Regarding Clause 4, Article 6 of the draft Resolution, there are opinions suggesting to clarify which provisions of the Land Law apply to land acquisition to form a logistics center? Chairman of the Law and Justice Committee Hoang Thanh Tung suggested that the Government further study Resolution No. 136/2024/QH15 on the organization of urban government and pilot a number of specific mechanisms and policies for the development of the city. Da Nang has regulations that land acquisition to build construction items to form a logistics center is implemented according to the provisions of Article 79 of the Land Law.

Concluding the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai suggested that the Government continue to review and fully institutionalize the Party's policies, especially Resolution No. 45-NQ/TW on the construction and development of Hai Phong City until 2030, with a vision to 2045, and Conclusion No. 96-KL/TW on continuing to implement Resolution No. 45-NQ/TW to complete the draft Resolution, with specific mechanisms and policies, outstanding and breakthrough development, promoting decentralization and delegation of power to create momentum for the development of Hai Phong City. The Vice Chairman of the National Assembly also noted, "Do not include in the Resolution policies under the authority of the Government, not under the authority of the National Assembly, policies that have been and will be included in other laws, especially carefully reviewing regulations on land recovery to ensure compliance with the Constitution".

The Vice Chairman of the National Assembly emphasized that, in order to implement the Party's policy, Hai Phong will change and expand its administrative boundaries. Therefore, to ensure the feasibility, comprehensiveness and stability of the Resolution, it is necessary to study and cover the new administrative boundaries after the reorganization, not only to promote the potential, strengths, geographical, economic and cultural characteristics of Hai Phong at present, but also to take into account Hai Phong when expanding. At the same time, it is necessary to pay attention to the impacts of the reorganization and reorganization of the apparatus according to the policies, directives and conclusions of the central government, and review policies for suitability and feasibility, especially the non-organization at the district level and the reorganization at the commune level.

Each policy needs to have principles, criteria, and conditions for implementation, ensuring clarity and transparency when applied, associated with the responsibilities of relevant agencies, units, organizations, and individuals, ensuring efficiency, thrift, fighting waste and negativity, preventing loss and waste, ensuring the legitimate interests of the people, and harmonizing the interests of the State and investors,” the Vice Chairman of the National Assembly noted.
