
From people's petitions to party committee actions
The Cho Moi – Bac Kan expressway is nearly 29km long, passing through many residential areas and mountains. According to the approved compensation plan, more than 300 graves of households in Bac Kan city and Cho Moi district have been compensated and relocated.
However, a reality arose: There were 44 graves affected (the closest grave was 0.5m from the reclamation boundary, the farthest grave was 9m from the reclamation boundary). These graves were at risk of being affected by landslides, construction machinery, losing their aesthetic appeal and affecting the spirituality according to people's beliefs.
Mr. Ha Van Tau, Na Bia village, Nong Ha commune said: His family has 08 graves within the land acquisition area for the Project. In compliance with the State's policy, his family moved 07 graves early. However, there is 01 grave in the same family cemetery that is outside the acquisition boundary even though it is only 5m away. Mr. Tau hopes that the State will consider compensating the family for this grave so that they can continue to move to the family's new cemetery, because the upcoming road construction with machinery and vehicles will certainly affect the actual site as well as the spiritual aspect.

Mr. Dinh Khac Tich, Na Ban village has 02 graves in Reo Dai village, Nong Ha commune. The designed road goes between these 02 graves, in which 01 grave is located on the road, 01 grave is located outside next to it. The family really hopes to be compensated for this grave. If left, the grave will be separated from the rest of the family grave area.
Mr. Be Van Thuc's household in Na Bia village has 3 graves, but 2 have been compensated, and 1 is outside the land acquisition boundary but also close to the road. Although he only received compensation for moving 2 graves, the family also relocated the grave that had not been compensated. Mr. Thuc hopes that the State will consider compensation for this grave.
Not only the three households above... other households with graves close to the reclaimed boundary in Bac Kan city and Cho Moi district within the Cho Moi - Bac Kan expressway clearance area also expressed their wish that the State would support funding to relocate the remaining graves outside the boundary but close to the route, because "it is impossible to leave a grave alone in the middle of the construction site".
This concern was received, compiled and reported to the Provincial People's Committee by the People's Committee of Bac Kan City and Cho Moi District. The Provincial Party Committee Standing Committee also quickly grasped the situation through reports from the relevant agencies, and at the same time unanimously directed: Must be flexible, humane, apply legal regulations to resolve the issue in a reasonable manner.
The Provincial People's Committee issued other support policies: Removing bottlenecks in site clearance
On June 3, 2025, the People's Committee of Bac Kan province issued Document No. 4416/UBND-NNTNMT, officially allowing the application of other support measures according to Clause 2, Article 108 of the 2024 Land Law. Accordingly, for graves (whether owned or unowned) located within 10m from the recovery boundary, if recorded in the inventory record, will be supported as for land in the safety corridor of construction works, according to Article 106 of the Land Law and Article 18 of Decree 88/2024/ND-CP.

This policy not only resolves the "border" graves that are causing problems, but also meets the wishes and beliefs of the people, and does not violate the law, because it is applied correctly within the legal framework prescribed by the National Assembly and the Government.
Not only that, the province also clearly directed: The application of support must ensure fairness, correct subjects, be confirmed by the commune government and organized for public and transparent counting.
Remove difficulties to open the way
The Cho Moi – Bac Kan Expressway Project is a key project of strategic significance, helping to connect the center of Bac Kan province with the Hanoi – Thai Nguyen Expressway, creating momentum for regional economic development. However, the problem of land clearance is always a big challenge. In particular, supporting graves outside the boundary is a "bottleneck" that causes great obstacles if not handled skillfully.
According to statistics, in Bac Kan city alone, there are 09 graves and in Cho Moi district, there are 35 graves located in high-risk areas, close to the road's positive slope, which are likely to be directly affected during construction. If not resolved, people will be upset, which may lead to complaints, delay the construction progress and affect the image of the project.
Consensus for development
The issuance of other support policies clearly demonstrates the strong leadership of the Provincial Party Committee, the proactiveness, flexibility and listening of the Bac Kan Provincial People's Committee. Thanks to that, many households have confidently cooperated in the relocation, no longer feeling resentful or worried about the unresolved spiritual issues.

Ms. Le Thi Thu Ha, Deputy Director of the Center for Land Fund Development of Bac Kan City said: “This is the legal basis for us to apply to pay and resolve problems in the process of performing our tasks. Surely knowing this information, households eligible for support will be very excited.”
This other support policy is also an important lesson for future projects, especially in localities with complex terrain and customs and practices imbued with indigenous culture such as Bac Kan. Listening to the people and properly applying legal regulations to flexibly handle arising situations is the foundation for building a harmonious, humane and sustainably developed society.
With the synchronous, drastic and humane participation from the Provincial Party Committee to the Provincial People's Committee, the story of supporting the relocation of graves in Bac Kan is not only a solution for a single road, but a symbol of the spirit of "people are the root" in all development policies./.
