10th Session: Innovation in recruitment, use and management of civil servants according to job positions

The draft Law on Civil Servants (amended) proposes to innovate the mechanism for recruiting, using, and managing civil servants according to job positions, creating connectivity between the public and private sectors, and attracting high-quality human resources.

On the morning of October 22, continuing the working program, the National Assembly listened to the presentation and review report of the draft Law on Civil Servants (amended).

Restructuring and improving the quality of civil servants

Briefly presenting the Report, Minister of Home Affairs Pham Thi Thanh Tra stated that the development and promulgation of the draft Law on Public Employees (amended) aims to comprehensively innovate the recruitment, use and management of public employees according to job positions to institutionalize the Party's policy on restructuring and improving the quality of public employees; create a mechanism for connecting human resources between the public and private sectors; attract and use high-quality human resources to improve the operational efficiency of public service units associated with the mechanism of autonomy and self-responsibility, suitable to the characteristics of the sector and field to meet the requirements and tasks in the new situation.

The Draft Law on Civil Servants (amended) consists of 6 chapters and 43 articles (19 articles less than the current Law).

Pointing out some highlights of the draft Law, the Minister of Home Affairs said that the draft Law innovates the recruitment, use, and management of civil servants according to job positions.

Regarding the management and use of civil servants according to job positions, the draft Law clearly stipulates that the recruitment, management, arrangement and use of civil servants must be based on the requirements of the job positions and the capacity and effectiveness of the civil servants in performing their duties; there will be no examination or consideration for promotion of civil servant professional titles.

At the same time, innovate the recruitment of civil servants in the direction of clearly defining the form of competitive examination, public and equal selection and the form of reception for high-quality human resources.

Public service units are proactive in choosing recruitment methods appropriate to their industry and field of operation, aiming for a professional and modern management model. For civil servants and public employees who move to work at a new public service unit, they must carry out job transfer procedures.

The Draft Law expands the rights of civil servants in the direction of regulating the conditions for civil servants to sign contracts to perform professional activities at public service units other than the public service unit they are currently working for or at other non-public agencies, organizations, and units.

Officials working in public science and technology organizations and public universities are allowed to contribute capital, participate in the management and operation of enterprises, work at enterprises established by such organizations, or participate in establishing them to commercialize research results created by such organizations with the consent of the head of the organization.

In case the management official is the head of a public science and technology organization or public university, he/she must have the consent of the direct superior.

The draft Law supplements regulations to encourage and protect innovative civil servants who dare to think, dare to do, dare to break through, and dare to take responsibility for the common good.

In addition, the draft Law innovates the mechanism for determining job positions in the direction of clearly defining 3 groups of job positions in public service units, including management job positions (job positions in leadership and management positions appointed according to Party regulations and laws); professional and technical job positions according to each major in public service units (for these job positions, they must meet the standards and conditions of the specialized management ministry); support job positions (including shared job positions to serve the operation of public service units such as finance, accounting, personnel organization, office...), not including service positions such as drivers, security guards, janitors...

Apply digital technology and build a national database on civil servants to ensure publicity and transparency in evaluating, managing and developing the civil servant team.

The Draft Law also stipulates the creation of connectivity in the use of human resources between the public and private sectors associated with the implementation of mechanisms to attract and utilize high-quality human resources; innovation in the management of public service units associated with improving the effectiveness of managing the staff; innovation in the mechanism of evaluating civil servants to improve the quality and effectiveness of serving the people and society.

Presenting the report on the review of this content, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung basically agreed with the conversion of the method of managing civil servants according to job positions to suit the current trend of public sector reform, meeting the requirements of "strongly innovating methods of recruitment, assessment, planning, training, fostering, arranging and using cadres, civil servants and public employees in the political system" in Conclusion No. 121-KL/TW of the 13th Party Central Committee, contributing to creating a legal basis for paying civil servants' salaries according to job positions; ensuring consistency and unity with the method of managing cadres and civil servants prescribed in the Law on Cadres and Civil Servants.

The Government is interested in directing the process of building a list of job positions to ensure true scientific and quality.

The National Assembly's Committee on Law and Justice approved the regulation that civil servants are allowed to sign labor contracts or service contracts with other agencies, organizations and units that are not contrary to the agreement in the employment contract and are not prohibited by law, in order to take advantage of the capacity and professional experience in the professional activities of civil servants to contribute to society and increase legitimate income for civil servants...

Perfecting mechanisms and policies in the field of civil aviation

Earlier that morning, the National Assembly heard the presentation and review report of the draft Law on Civil Aviation of Vietnam (amended).

Presenting the draft Law on Vietnam Civil Aviation (amended), Minister of Construction Tran Hong Minh said that the drafting of the Law is necessary to promptly institutionalize the Party's guidelines and policies; overcome difficulties and shortcomings arising from practice, and implement international commitments that Vietnam participates in the field of civil aviation.

The Draft Law has 11 chapters and 109 articles (93 articles less than the current Law); aiming to institutionalize the Party and State's guidelines and policies; perfect mechanisms and policies in the field of civil aviation; implement Vietnam's commitments to the international community; enhance the effectiveness and efficiency of state management in the field of civil aviation; overcome difficulties and shortcomings; propose solutions to new and emerging issues; unlock potentials, create new driving forces for socio-economic development and international integration; ensure national defense and security in the new era - the era of national development.

Presenting a summary of the review report, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung said that the majority of opinions in the National Assembly's Committee on Law and Justice agreed with the regulation that "Vietnam's aviation authorities, Vietnam's aviation security authorities... are allowed to retain part or all of the collected fees to support the improvement of human resource quality, international cooperation, investment in development and modernization to improve the capacity to monitor aviation safety and security according to ICAO standards."

However, some opinions suggested not to regulate the above content, because according to the provisions of the Law on Fees and Charges and the Law on State Budget, all fees collected from service activities performed by state agencies must be paid into the state budget.

The majority of opinions in the National Assembly's Committee on Law and Justice agreed with the regulation that "Vietnam Aviation Authorities and Aviation Security Authorities are entitled to monthly support of up to 80% of their current salary coefficient (excluding allowances) from retained fees" to ensure that Vietnam Aviation Authorities attract and retain high-quality human resources, especially the aviation safety supervisor team.

This is one of the contents of the special financial mechanism that has been allowed by the Prime Minister to be applied to officers and civil servants of the Civil Aviation Authority of Vietnam. In order to have a basis for regulating this content in the draft Law, opinions suggest that the Agency submit a report and ask for opinions from competent authorities.

Some opinions suggested not to stipulate the above content in the draft Law because Resolution No. 27-NQ/TW on reforming salary policy for cadres, civil servants, public employees, armed forces and employees in enterprises required "Not to link the salary level of cadres, civil servants and public employees with the development, amendment and supplementation of documents regulating policies and regimes that are not of a salary nature".../.
