(DN) - On May 9, the Provincial People's Court conducted a debate on the defendants' criminal acts and handled related assets in the case of fraud and property appropriation at Dong Nai Real Estate Joint Stock Company (located in Tan Hiep Ward, Bien Hoa City).

In the indictment, the representative of the Provincial People's Procuracy determined that the defendant Do Son Tung (Chairman of the Board of Directors, Director of Dong Nai Real Estate Joint Stock Company) had no financial capacity but hired subordinates who were other defendants in the case including: Le Huu Trung (38 years old, residing in Trieu Son District, Thanh Hoa Province); Nguyen Bao Tran (44 years old, residing in Tan Phong Ward, Bien Hoa City); Pham Thanh Loc (38 years old, residing in Buu Long Ward, Bien Hoa City); Nguyen Thanh Tam (43 years old, residing in Thot Not District, Can Tho City ); Ha Huy Huyen (53 years old, residing in Tan Hiep Ward, Bien Hoa City) to carry out the tasks of buying and selling land in 4 "ghost" projects that Tung established in Bau Ham and Song Thao communes (Trang Bom District).
Tung played the role of organizer, assigning tasks to other defendants in the case. The defendant used the nearly 123 billion VND embezzled money for personal purposes and the amount of unrecovered damage was particularly large. The defendant's actions caused outrage in society, causing damage to many families. Therefore, the defendant should be given a very severe sentence, commensurate with the defendant's actions. The other accomplices in the case all played a role in helping Tung embezzle nearly 123 billion VND.
Therefore, the Provincial People's Procuracy proposed to sentence defendant Do Son Tung to life in prison; defendant Trung to 14-16 years in prison; defendant Tran to 12-14 years in prison; defendant Tam to 8-10 years in prison; Loc to 5-7 years in prison and Huyen to 2-4 years in prison.
The representative of the Provincial People's Procuracy also proposed to continue to temporarily detain the amount of 400 million VND seized in the case; continue to seize 10 plots of land of the defendant Tung to ensure execution of the judgment.
Arguing with the representative of the Provincial People's Procuracy, the defense lawyers agreed on the charges against the defendant Tung and his accomplices. However, the lawyer requested a reduced sentence for the defendant Tung because of circumstances such as: first-time offender, having compensated part of the property to the victims in the case, the economic situation that caused the defendant to have a distorted perception... As for the defendants who were subordinates of the defendant Tung, the lawyer requested that the lightest sentence be considered because the defendants were only salaried employees, following the instructions of their superiors and did not benefit from the case.
Also at the trial, the defense attorney for the victims requested to continue to seize 10 plots of land belonging to defendant Tung in the case to enforce the judgment and return part of the damaged assets to the victims. The attorneys also requested to recover the entire amount of money Tung paid as commissions to employees, collaborators, etc. when buying and selling land in the project.
The defense attorney for the people with related rights and obligations in the case, Mr. Thai Quang and his wife (owner of Quang Thanh pawn shop, Bien Hoa city); Ms. Le Thi Bong (owner of Quoc Cong pawn shop, Bien Hoa city) argued that the 10 plots of land on Tung had been sold to the pawn shop owners, the sale transaction had been completed and was not a mortgage transaction. Therefore, the panel of judges requested that they be returned to the pawn shop owners.
It is expected that at 3:00 p.m. on Monday, May 15, the Provincial People's Court will announce the verdict for the defendants in the above case.
