Consulting voters on administrative unit arrangement

The Provincial People's Committee issued Plan 425/KH-UBND, dated April 15, 2025, on organizing the collection of voters' opinions and submitting them to the People's Council meetings at all levels on the Project on rearranging administrative units (ADUs) at the commune and provincial levels. The organization of collecting voters' opinions; information and propaganda on collecting voters' opinions must be conducted publicly, democratically, in accordance with the law, ensuring social order and safety.

Clause 3, Article 10 of the Law on Organization of Local Government 2025 stipulates: “Projects to establish, dissolve, merge, divide administrative units, adjust boundaries and rename administrative units must be consulted with the People in commune-level administrative units directly affected. The Provincial People's Committee is responsible for organizing the consultation with the People on the policy of establishing, dissolving, merging, dividing administrative units, adjusting boundaries and renaming administrative units in appropriate forms according to Government regulations”.

In Clause 2, Section II, the Plan issued with Resolution 74/NQ-CP, dated April 7, 2025 of the Government on the Plan for implementing the arrangement of administrative units and building a model of organizing a 2-level local government stipulates: "The provincial People's Committee organizes to collect opinions from voters representing households in the area of ​​the provincial-level administrative unit to be merged (for the policy of arranging provincial-level administrative units), in the commune-level administrative units directly affected (for the policy of arranging commune-level administrative units); decides on the form, order, procedures, and time limit for collecting opinions in accordance with the practical conditions of the locality, ensuring the progress of submitting the dossier of the administrative unit arrangement project according to the requirements in Conclusion 137-KL/TW and this resolution".

Thus, to ensure consistency in content, order and procedures for collecting opinions from local people, the provincial People's Committee can choose the form of distributing opinion ballots or choose another suitable form (such as collecting ballots via electronic information pages, meetings of household representatives at commune, village and residential group administrative units to vote...). In An Giang, the Project on arranging administrative units at commune and provincial levels is organized to collect opinions from all voters representing households with permanent residence in the area, according to each hamlet and residential group. The ballots are in the direction of "agree", "disagree" or "other opinions". According to regulations, by April 16 at the latest, the commune-level People's Committee will decide to establish a Voter Opinion Collection Team according to hamlet and residential group areas. Each team has 5-7 members, including: The team leader is the Party cell secretary or hamlet and residential group head; team members are representatives of socio-political organizations and prestigious citizens in the hamlet and residential group; The secretary is a cadre, civil servant or teacher working in the area.

The People's Committee at the commune level shall make a record summarizing the results of the voter consultation in the locality and send it to the People's Council at the same level; make a summary report and send it to the People's Committee at the district level no later than April 20. Along with that, correctly determine the scope and subjects of the project; organize locations for collecting voters' opinions in accordance with the characteristics of the population, ensuring safety, savings, efficiency, publicity, democracy, and compliance with the provisions of law. Provide full and timely information and propaganda to voters about the reasons and necessity of implementing the arrangement of administrative units at the commune level; thereby creating high consensus and unity between the Party Committee, the government, and the people in the area.
