Mass recall of cosmetic declaration forms

According to the decisions announced by the Drug Administration, the recall of product declaration forms is mainly by domestic companies producing or importing. There are even days when the number of products requested for self-recall is up to 300 products from many different companies.

Some cosmetic import companies have proposed to recall the product declaration forms of many famous brands. After the information was published, many brands have spoken out to confirm that the recall is not related to their genuine production and distribution activities in Vietnam.

For example, Unilever Vietnam, the owner of the Dove brand, said that genuine Dove products are still being distributed legally, ensuring quality and having full licenses and anti-counterfeit stamps.

Similarly, Bioderma Vietnam also affirms that their genuine products are imported through official channels, have authentication stamps and comply with current legal regulations.

Explaining this issue, speaking with Tuoi Tre Online , Mr. Ta Manh Hung, deputy director of the Department of Drug Administration, said that according to current regulations, only cosmetic products that have been granted a registration number by the management agency are allowed to circulate on the market.

At the same time, the unit named in the declaration file must take full responsibility for the safety, effectiveness and quality of the product.

According to Mr. Hung, the unit responsible for the announcement is not necessarily the manufacturer or brand owner. In this case, they must have a legal authorization to carry out the announcement and distribution of the product in Vietnam.

"Therefore, a cosmetic product can have many different declaration units, unless there is exclusive authorization from the company," Mr. Hung clearly stated.

Accordingly, the regulation on cosmetic product declaration receipt number is valid for 5 years from the date of issue and can be revoked if the enterprise voluntarily requests or when the product violates current regulations.

Self-revocation may still be subject to action if violated

Mr. Hung said that according to Circular 06/2011/TT-BYT, in some cases, when a product violates the law, the authorities will request the recall of both the declaration form and the product. But there are also situations where only the product is recalled but not the declaration form, or vice versa.

In cases where a business voluntarily requests to withdraw the declaration form without requesting to recall the product, when there is no evidence proving that the product violates quality or is unsafe, the product is still allowed to circulate until its expiry date.

Mr. Hung also stated that recently, the number of units voluntarily withdrawing declaration forms has increased rapidly. The businesses said that this was because they no longer had business plans for that product, however, the Drug Administration did not rule out other reasons.

"The Department has been coordinating with relevant agencies to consider and resolve the issue," Mr. Hung emphasized.

In case the enterprise voluntarily withdraws the cosmetic declaration form without a request to voluntarily recall the cosmetic product, the Department will base on the risk factors, recommendations reflecting signs of violations in quality and safety (if any), the competent authority will take measures such as increasing supervision of these products to ensure the safety and rights of users.

"When violations are detected, the product will be recalled and the business responsible for bringing the cosmetic product to market will be handled in accordance with regulations," Mr. Hung affirmed.
