According to the indictment of the Provincial People's Procuracy, from 2022 to 2023, when knowing that there were many infertile couples who could not conceive, people (single fathers, single mothers) who wanted to have children and many women who wanted to be surrogate mothers to earn money, TTTTr. had the idea of ​​organizing surrogacy for the purpose of making illegal profits.

Tr. used many Facebook accounts to join groups and associations to search for and contact people who wanted to hire surrogates and women who accepted surrogacy, then negotiated the price of surrogacy in order to enjoy the difference in money; guided couples who wanted to have children to go through the procedures for examination, infertility treatment, and embryo creation at the hospital.

When a woman accepts to be a surrogate mother, Tr. guides these people to have reproductive health check-ups and complete embryo implantation procedures as a single mother applying for an embryo. In addition, Tr. also rents a house, arranges for caretakers, nutrition, health monitoring, and prenatal check-ups... for the surrogate women until they give birth.

Infertile couples who wanted to have children had to pay someone else to be a surrogate mother; the surrogate mothers received the surrogacy fee and Tr. himself and his accomplices received the difference (during the course of committing the crime, Tr. hired TVTh. to help Tr. do some work to organize the surrogacy).

During the investigation, the Provincial Police Investigation Agency discovered that Tr. and Th. had organized three surrogacy cases together. Case 1: The surrogate mother was a woman born in 1995, residing in Phan Ri Cua, Tuy Phong district, Binh Thuan province and the person who hired the surrogate mother was a young man born in 1992, residing in Ward 8, District 5, Ho Chi Minh City.

Because he wanted to become a single father, through the social network Facebook, the young man above contacted Tr. to discuss hiring Tr. to find a surrogate mother. Tr. agreed and agreed on a total price of 1 billion VND, including the cost of food, testing, medical examination for the surrogate mother and the costs related to embryo implantation and Tr.'s salary.

Also through social networks, the woman in Binh Thuan mentioned above learned that Tr. was looking for a surrogate mother, so she contacted Tr. through Tr.'s Facebook. The two agreed on a surrogate mother fee of about 250 million VND.

After conducting a health check and determining that the woman was eligible to become pregnant, Tr. took the young man and the woman to the hospital to collect sperm and eggs; performed in vitro fertilization; then implanted the embryo into the woman's body so that she could become pregnant.

Since becoming pregnant, Tr. has rented a place for the woman to rest in room 908-C1 of Vicoland Apartment, Xuan Phu Ward, Hue City. Every day, Tr. provides all necessities for this woman and organizes her for regular pregnancy check-ups. Because the police discovered this, Tr. has not had time to illegally profit from this case.

In response to the need for a child of a family in Dong Nai province, using the above methods, Tr. continued to organize surrogacy; however, he was also discovered by the police so he did not have time to make any illegal profits.

In the third case, Tr. and Th. organized surrogacy for a lesbian couple who wanted to have a child together. After discussion, the two sides agreed on how to carry out the surrogacy: One of the couple would be the pregnant woman, the egg to be fertilized would come from the other woman. Tr. would contact and buy the sperm himself.

Tr. will carry out the procedures at the hospital, the cost of performing all the above activities is 200 million VND. As a result, the woman became pregnant and gave birth to a baby boy. After successfully performing the procedure, after deducting expenses, Tr. earned 26.5 million VND. During the process of committing the crime, Th. illegally earned 15 million VND.

Tr. and Th. were prosecuted by the Provincial People's Procuracy for the crime of "Organizing surrogacy for commercial purposes" under Point b, Clause 2, Article 187 of the Penal Code, with a penalty of 1 to 5 years in prison. Currently, the Provincial People's Court is preparing to bring the case to trial, both Tr. and Th. must "face" the verdict of the law.

This is also a "warning" for anyone not to be tempted by illegal "jobs" and profits, which are prohibited by law.
