The draft Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (amended) will increase the duration of e-visas from 30 days to 3 months, valid for single or multiple entries.

The Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam will ensure the purposes of contributing to simplifying procedures, promoting the implementation of administrative procedures in the electronic environment, continuing to create favorable conditions for Vietnamese citizens in the issuance of exit and entry documents and foreigners in exit, entry, transit and residence in Vietnam, promoting tourism development.
Decentralization of handling lost passport reports
Authorized by the Prime Minister, Minister of Public Security To Lam presented the Report on the draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam at the National Assembly hall on the morning of May 27.
According to Minister To Lam, the Government and the Prime Minister have issued many Resolutions and Decisions approving the "National Digital Transformation Program to 2025, with a vision to 2030", continuing to reform administrative procedures and promote tourism development as a key economic sector; compared to 2019 (before the COVID-19 outbreak), in 2022, the number of international visitors to Vietnam only reached 32.6%.
However, through review, the provisions of the 2019 Law on Exit and Entry of Vietnamese Citizens and the 2014 Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (amended and supplemented in 2019) have not met political, legal and practical requirements.
“The development of the Law aims to ensure the purposes of contributing to simplifying procedures, promoting the implementation of administrative procedures in the electronic environment, continuing to create favorable conditions for Vietnamese citizens in issuing entry and exit documents and foreigners entering, exiting, transiting, and residing in Vietnam; contributing to making tourism a spearhead economic sector, creating conditions for investors to explore the market and invest,” Minister To Lam emphasized.
Accordingly, the Draft Law adds Clause 9 to Article 15, amends Clause 2, Article 28, and amends Clause 2, Article 32 to supplement the form of submitting documents in the electronic environment for procedures for requesting the issuance of ordinary passports, reporting the loss of ordinary passports in the electronic environment, and restoring the validity of ordinary passports.
The Draft Law amends Clause 2, Article 15 to abolish the regulation on submitting a copy of the Identity Card or Citizen Identification Card in cases where there is a change in personal information compared to the information in the most recently issued passport and abolishes the regulation on submitting a copy of the birth certificate or birth extract for people under 14 years old who have been issued a personal identification number.
Amend and supplement Clause 2, Article 28 to decentralize the handling of reports of lost ordinary passports from the Immigration Department to the Provincial Police, from the Provincial Police to the District Police, and from the District Police to the Commune Police.
The draft Law amends Point a, Clause 1, Article 33, stipulating that the remaining validity period of a passport must be 6 months or more to be eligible for exit, in the direction that a passport with remaining validity is eligible for exit (removing the provision that the remaining validity period of a passport must be 6 months or more to facilitate citizens when exiting the country).
Increase temporary residence period for foreigners to 45 days
The group of contents amends the provisions of the Law to continue to create more favorable conditions for foreigners to enter and exit Vietnam. Accordingly, the draft Law amends and supplements the provisions in Articles 7 and 9 to increase the duration of the electronic visa from 30 days to 3 months, valid for one or multiple entries; amends and supplements the provisions in Article 19a to expand the issuance of electronic visas to citizens of all countries and territories and assigns the Government to decide on a specific list of countries and territories.
The draft Law supplements Article 31 to increase the temporary residence period from 15 days to 45 days for citizens of countries that Vietnam unilaterally exempts from visas and are considered for visa issuance and temporary residence extension according to other provisions of the Law.

The group of amended contents to manage the residence of foreigners in Vietnam, contributing to protecting national security and ensuring social order and safety. Accordingly, the draft Law amends and supplements Article 33 to supplement the responsibilities of accommodation establishments; amends Clause 2, Article 44 to supplement the obligations of foreigners in presenting their passports and valid papers of residence in Vietnam to accommodation establishments to make temporary residence declarations according to regulations.
Regarding the report on the review of the draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi basically agreed on the necessity of amending and supplementing the Law with political, legal and practical bases as stated in the Government's Submission.
The National Defense and Security Committee agreed that increasing the time limit for granting temporary residence certificates at the border gate for people entering under unilateral visa exemption from 15 days to 45 days is appropriate to the current situation when the demand for long-term entry into Vietnam is increasing, especially for foreigners coming to invest, work with agencies, businesses, other organizations, travel or carry out other activities. The 45-day regulation is at the average level of countries in the region. There are opinions suggesting increasing the temporary residence period to a maximum of 60 days to be more flexible in granting temporary residence certificates.
Some opinions say that, as of now, Vietnam unilaterally exempts visas for citizens of 25 countries, which is much lower than that of other countries in the region, so it is recommended to expand the scope and conditions for unilateral visa exemption for citizens of other countries and territories.../.
