Fee levels and exemptions:
Article 4 of Circular No. 16/2025/TT-BTC stipulates the fee collection level as follows:
1. The fee for providing criminal record information is as follows:

In case the person requesting the issuance of a criminal record certificate requests to issue more than 2 criminal records certificates at one time, from the 3rd certificate onwards, the fee collection organization may collect an additional 5,000 VND/certificate.
2. Fee for providing criminal record information for cases of submitting applications for criminal record certificates online (including via VNelD application):
a) From April 24, 2025 to December 31, 2025, the fee for providing criminal record information will be as follows:

In case the person requesting the issuance of a criminal record certificate requests to issue more than 2 criminal records certificates at one time, from the 3rd certificate onwards, the fee collection organization shall collect an additional 5,000 VND/certificate.
b) From January 1, 2026 onwards, the fee collection rate specified in Clause 1 of this Article shall apply.

Cases exempted from fees are specified in Article 5 of Circular No. 16/2025/TT-BTC, specifically:
1. Children as defined in the Law on Children (people under 16 years old).
2. Elderly people as prescribed in the Law on the Elderly (Vietnamese citizens aged 60 or older).
3. Persons with disabilities as prescribed in the Law on Persons with Disabilities (persons with one or more body parts or impaired functions manifested as disabilities that make work, daily life, and study difficult).
4. People belonging to poor households or near-poor households according to the provisions of the law on poverty standards.
5. Residents in extremely disadvantaged communes, ethnic minorities in communes with extremely difficult socio -economic conditions, border communes, and safe zone communes as prescribed by law.
Scope of regulation, applicable subjects
- Circular No. 16/2025/TT-BTC stipulates the collection rate, collection, payment, management and use of fees for providing criminal record information in cases where Vietnamese citizens and foreigners request to be issued criminal record certificates.
- This Circular applies to payers and organizations collecting fees for providing criminal record information, other organizations and individuals related to the collection, payment, management and use of fees for providing criminal record information.
- Fee payers are Vietnamese citizens and foreigners who, when submitting an application for a criminal record certificate, must pay the fee according to the provisions of this Circular.
- The fee collection organization is a state agency with the authority to issue criminal records according to the provisions of law and is the fee collection organization according to the provisions of this Circular.
