Tax industry transfers many violation records to investigation agencies

From May 29 to June 2, local tax departments will accelerate the settlement of value-added tax (VAT) refund dossiers for businesses and people. For VAT refund dossiers with problems and feedback from associations and businesses, dialogues must be organized immediately to clarify the problems; proactively handle and resolve problems and carry out tax refunds in accordance with regulations and authority, not allowing them to linger for a long time, causing frustration.

Implementing the Prime Minister's direction in Official Dispatch No. 470, the Ministry of Finance issued Official Dispatch No. 5427 notifying the Minister's direction to the General Director of the General Department of Taxation to urgently implement and direct the Tax Departments of provinces and centrally-run cities to promptly resolve VAT refund dossiers for the right subjects and in accordance with the provisions of law.

This content was immediately communicated to representatives of hundreds of enterprises. Some enterprises raised difficulties in VAT refunds. Especially for enterprises in the electricity industry, the refunded VAT is an important financial source to pay for project costs and contractors.

Mr. Tomoki Kawasaki, Finance Director, Van Phong Power Company Limited, Khanh Hoa Province, expressed that the current difficulty of the enterprise is the delay in VAT refund for 2 years, because the enterprise does not have an electricity license. " According to the regulations of the electricity industry, the license is only granted when the project is put into operation, but currently the project is in the investment phase and is expected to last about 4 - 5 years", Mr. Tomoki Kawasaki stated the difficulty.

Ms. Le Thi Duyen Hai, Director of the Tax Declaration and Accounting Department, General Department of Taxation (Ministry of Finance), said that the tax sector has received VAT refund dossiers from 99% of enterprises, currently nearly 80% of enterprises are eligible for pre-refund within 6 days. The tax sector has also classified risks, with enterprises without risks being refunded in accordance with regulations, promptly and even in advance.

Regarding the list of enterprises that have traded illegal invoices in the recent past, the enterprises themselves have reviewed their records and have withdrawn or canceled their records to make adjustments and then requested tax refunds. At the same time, through tax management, it has also been verified that goods and invoices must comply with regulations, and some records have been transferred by the tax authority to the investigation agency for handling according to the law.

“In high-risk cases identified by the tax sector as being related to fraudulent tax refund invoices, the General Department of Taxation has been urging tax authorities at all levels to speed up the process of verifying the source of input, in order to continue to handle the refunded tax amount that businesses have implemented in accordance with the law. For invoices that businesses cannot prove the input, the tax sector will take measures to handle them, and in some cases, will even transfer them to the investigation agency,” said Ms. Duyen Hai.

Recently, nearly 80% of VAT refund dossiers subject to pre-refund and post-audit have been promptly processed by tax authorities within 6 working days from the date of receipt of complete refund dossiers from taxpayers. The prompt and timely processing of tax refund dossiers in accordance with the provisions of the Law on Tax Administration has created conditions for enterprises to quickly turn over capital, improve efficiency in capital use, and contribute to the development of production, business, and export of goods.

For VAT refund applications that have been checked and determined to be eligible for refund, the tax sector will promptly issue tax refund decisions to enterprises, ensuring compliance with the prescribed deadline. For VAT refund applications that are being checked and verified to be eligible for refund, the tax sector will notify taxpayers of the progress of the application processing and the expected time to process the tax refund for taxpayers, ensuring publicity and transparency. For tax amounts that have been checked and verified, tax refunds will be promptly processed for taxpayers according to regulations, without waiting for full verification before processing the refund for taxpayers.

The General Department of Taxation will review any problems beyond its authority to report to the Ministry of Finance and report to competent authorities for consideration and decision in accordance with the content and direction of the Minister of Finance in Official Dispatch No. 5427 dated May 26, 2023, to ensure strict VAT refunds in accordance with legal regulations, while supporting and facilitating business operations.
