
The 2025 Employment Law takes effect from January 1, 2026. The law stipulates that the monthly unemployment benefit for employees is equal to 60% of the average monthly salary for unemployment insurance contributions of the 6 consecutive months before unemployment, but not exceeding 5 times the regional minimum monthly wage. In addition, according to Decree No. 293 of the Government recently issued, from January 1, 2026, the regional minimum wage for employees will also be adjusted to increase, from 3.7 to 5.31 million VND/month.
Thus, the maximum unemployment benefit that employees can receive is from 18.5 to 26.55 million VND/month. Also according to the 2025 Employment Law, employees are entitled to a maximum of 12 months of unemployment benefits, equivalent to 144 months of contributions. Therefore, if receiving the maximum prescribed time and benefit level, employees can receive a maximum unemployment benefit of from 222 to 318.6 million VND/year. The 2025 Employment Law is a major step forward in social security policy, helping employees to be better protected against unemployment risks; creating conditions for businesses to be more proactive in human resource management.
