According to the new regulations, on the 25th of every month, the network operator will have to send a notification to subscribers about the service name and information content service packages that the user is using.
The Government has issued Decree No. 147/2024/ND-CP on the management, provision and use of Internet services and online information.
Sharing about some new points of Decree 147/2024/ND-CP, Mr. Tran The Phuong, Deputy Head of the Policy Department of the Department of Telecommunications ( Ministry of Information and Communications ) said that there are several points that businesses need to pay attention to when providing information content services on mobile telecommunications networks.
Accordingly, information content services on mobile telecommunications networks are understood as services provided by organizations and enterprises through telecommunications network infrastructure to mobile subscribers.
Content services do not include services to look up information about products and services of organizations and businesses, customer care and transaction confirmation.
Periodic mobile network information content services (daily, weekly, monthly, quarterly, yearly) are only provided after confirmation of consent and successful service registration notification sent to the user. Notification confirmation can be via SMS or other methods.
The notification must include the following information: The subscriber has successfully registered for [name of the service just registered]; code, telecommunication number to provide the service; billing cycle, price; how to cancel; support hotline.
“ Enterprises providing content services must comply with legal regulations on anti-spam, especially when sending messages to advertise services. Enterprises must create tools for users to look up transaction history for fees within 180 days from the date of registration. In case subscribers request to cancel the service, they must immediately send a notification message ,” said Mr. Tran The Phuong.
Content service providers must ensure that information complies with relevant legal regulations.
For mobile telecommunications businesses, Decree 147 also adds a number of responsibilities compared to previous legal regulations.
Specifically, mobile telecommunications enterprises are responsible for ensuring that they only connect to information content services that comply with relevant legal regulations.
Mobile telecommunications companies must be responsible when allowing content businesses to connect to their infrastructure.
Mobile telecommunications businesses are responsible for suspending or stopping connections in certain cases. “ For example, when detecting or receiving warning information or feedback about illegal content from providers, they must suspend or stop connecting to these content businesses ,” said a representative of the Telecommunications Department.
Mobile telecommunications enterprises must be responsible for stopping or suspending connections upon written request from competent state agencies. The time for implementation is no later than 24 hours from the time of request.
“ When a business providing content services has its registration certificate revoked or its number or code revoked by a state agency, it must stop connecting. When it does not have a connection certificate or the certificate has expired, it must also stop connecting, ” Mr. Tran The Phuong explained.
Mobile telecommunications enterprises must be responsible for controlling the entire process and system, ensuring that registration, authentication, renewal refusal, service cancellation... comply with the regulations stated in Decree 147.
On the 25th of each month, mobile telecommunications companies must send notifications to subscribers about the information content packages they are using. This notification includes the following information: service name, registered service package, and price.
Decree 147/2024/ND-CP will take effect from December 25, 2024.
