Many consequences when businesses owe social insurance

Việt NamViệt Nam20/07/2024

In recent years, the situation of evasion and debt of social insurance, health insurance, unemployment insurance by employers nationwide in general and in Ha Tinh province in particular has tended to increase. This not only causes difficulties in implementing social security policies but also directly affects the rights and legitimate interests of workers.

In early July 2024, Ms. Nguyen Thi Canh in Thach Ha town, Thach Ha district gave birth to her second baby at Ha Tinh General Hospital. Although she was working at Thai Ha Consulting and Construction Company, she still did not have a health insurance card to pay the hospital fees.

The reason is that the company owes more than 30 months of social insurance and health insurance, amounting to more than 85 million VND. Currently, Ms. Nguyen Thi Canh has to bear all the costs of the cesarean section.

Ms. Nguyen Thi Canh had to pay 100% of the hospital fees because she did not have health insurance.

At Ban Mai Kindergarten in Ha Tinh city, 17 teachers and employees also had their benefits affected because by the end of June 2024, the unit still owed more than 290 million VND in social insurance, health insurance and unemployment insurance.

Currently, in Ha Tinh, by the end of June 2024, there are more than 500 enterprises with social insurance, health insurance and unemployment insurance debt of 3 months or more with an amount of more than 99 billion VND.

Teachers at Ban Mai Kindergarten (Ha Tinh City) were also affected because the school still owed social insurance.

When a business owes mandatory social insurance contributions, this means that employees will have many benefits affected when they get sick, give birth, or have an accident.

Or when terminating the contract with the employee, the social insurance book cannot be closed, leading to the employee not being able to complete the procedures to receive unemployment benefits.

The law stipulates very specifically the responsibility of paying insurance for employees. Therefore, employers who are late in paying or evade payment are violating the law, directly affecting the rights of employees, while avoiding debt and late payment interest./.
