Accordingly, the starting price as prescribed in Clause 2, Article 2 of Decree No. 10/2025/ND-CP is determined by the mineral exploitation right fee (R) in the Decree stipulating the method of calculation and the mineral exploitation right fee (Decree No. 67/2019/ND-CP dated July 31, 2019 of the Government ; amended and supplemented by Decree No. 10/2025/ND-CP). Specifically, for common construction material minerals (sand, gravel, riverbed, stream, alluvial soil; brick and tile clay): R = 5%.

Price step: According to Clause 3, Article 2 of Joint Circular No. 54/2014/TTLT-BTNMT-BTC dated September 9, 2014 of the Ministry of Natural Resources and Environment - Ministry of Finance, the price step is the difference between the next bid and the previous bid; Point b, Clause 1, Article 4 of Joint Circular No. 54/2014/TTLT - BTNMT - BTC stipulates: The price step in areas where minerals have not been explored is determined according to the level of mineral exploitation right fee (R). Accordingly, the price step for common construction mineral materials (R') (%)=RxR% (for example, auction of construction sand mine: the fee for granting the right to exploit construction sand R = 5%, then the price step will be R' (%) = 5x5%=0.25. Then the fee for granting the right to bid R' = 5 + 0.25n, where n is an integer).
Deposit: The deposit is equal to 20% of the estimated mineral exploitation right grant fee based on the starting price specified in Clause 3, Article 2 of Decree No. 10/2025/ND-CP (amending and supplementing Article 5 of Decree No. 22/2012/ND-CP of the Government). Equity criteria: The equity of organizations and individuals participating in the auction of mineral exploitation rights must be at least equal to 50% of the total estimated budget of the Mineral Exploration Project as specified in Clause 4, Article 6 of Decision No. 20/2017/QD-UBND dated July 19, 2017 of the Provincial People's Committee. Accordingly, the total actual investment rate under similar conditions of exploration and approval of mineral reserves by the Provincial People's Committee is taken as the basis for establishing equity criteria when considering the dossiers of organizations wishing to participate in the auction.
The Department of Agriculture and Environment prepares the auction invitation documents, selects the property auction organization and carries out the auction according to regulations. After winning the auction and before granting the Mineral Exploitation License, the Department of Agriculture and Environment shall advise the Provincial People's Committee to approve the results of determining the auction winning price for the mineral exploitation rights according to regulations.
