On the morning of April 28, at the National Assembly House, the Standing Committee of the National Defense, Security and Foreign Affairs Committee held a seminar on the draft Law on Personal Data Protection. Member of the Party Central Committee, Vice Chairman of the National Assembly, Senior Lieutenant General Tran Quang Phuong attended and gave a speech.

Member of the Party Central Committee, Chairman of the National Defense, Security and Foreign Affairs Committee, Lieutenant General Le Tan Toi chaired the seminar.

Also attending were representatives of the Ministry of Public Security and relevant ministries, branches and units.

Speaking at the Seminar, Vice Chairman of the National Assembly Tran Quang Phuong highly appreciated the elaborate and thorough preparation process of the Drafting Agency and the Reviewing Agency of the draft Law on Personal Data Protection. Considering this a new and difficult Law project, the Vice Chairman of the National Assembly stated that personal data is both a strategic resource, permitted to be exploited according to regulations, but is owned by individuals, a special asset; when traded and used, it becomes a special commodity.

In the spirit of creating one of the breakthroughs in the revolution in science and technology, innovation and national digital transformation, the Vice Chairman of the National Assembly noted that new, mature and clear issues should be regulated by law, while issues with different opinions and not yet mature should be regulated in principle and assigned to the Government for detailed regulations for implementation.

The Vice Chairman of the National Assembly emphasized that the draft Law has many contents related to agencies, organizations, individuals, and enterprises - which are data subjects and to many fields of politics, economics, society, national defense, security, and foreign affairs. And one of the strict requirements is that the process of use, processing, and transfer, both domestically and across borders, must protect national security, maintain social order and safety, serve all activities well, ensure the release of resources, and create favorable conditions for production and business of organizations and enterprises.

The Vice Chairman of the National Assembly suggested that handling relationships in the digital environment is extremely complicated, so it is necessary to pay attention to handling them thoroughly, ensuring the rights and legitimate interests of the parties.

Regarding the content of the draft Law, Vice Chairman of the National Assembly Tran Quang Phuong suggested that the content of Chapter III on personal data protection during the process of processing personal data and Chapter IV on personal data protection during the process of using personal data need to be studied and transferred to make the provisions more appropriate, because these are two processes that often go together. At the same time, regarding the handling of violations of personal data protection regulations, it is necessary to study to ensure that if there are violations, there will be strict penalties, but it is also necessary to ensure that they are consistent with reality.

The Vice Chairman of the National Assembly also suggested a number of contents related to the application of the law on personal data protection; prohibited acts; data subject rights; personal data in cases where the consent of the data subject is not required; personal data protection organizations...

The Vice Chairman of the National Assembly suggested that the Standing Committee of the National Defense, Security and Foreign Affairs Committee receive and carefully study the opinions, in order to complete the draft Verification Report to send to the National Assembly deputies at the upcoming Ninth Session according to regulations, including specific explanations of issues in order to build a draft Law of the best quality.

Earlier, in his opening speech at the Seminar, Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi stated that personal data is increasingly playing an important role, not only related to the rights and legitimate interests of individuals as data subjects, but also a strategic data source, directly and comprehensively affecting politics, economics, society, national defense, security and foreign affairs. Practice shows that the work of protecting personal data still has loopholes, and many cases of illegal collection, attacks, appropriation and trading of personal data have been discovered.

Chairman of the Committee Le Tan Toi stated that the draft Law on Personal Data Protection is built on the spirit of inheriting and developing from Decree No. 13/2023/ND-CP of the Government on personal data protection. In particular, there are many new contents and many contents related to the processing of personal data of organizations and enterprises that will affect production, business activities and legal compliance costs. Therefore, the requirement for this draft Law is to protect personal data well in conjunction with protecting national security, maintaining social order and safety; must serve well the activities of agencies and organizations, unlock resources, and facilitate production and business of organizations and enterprises.

The Chairman of the Committee on National Defense, Security and Foreign Affairs hopes that delegates in each specific field will promote their spirit, responsibility, enthusiasm, and contribute ideas to help the Committee have more basis to complete the Verification Report before submitting it to the National Assembly.

At the Seminar, delegates agreed that the development of the Law on Personal Data Protection is extremely necessary to meet political and legal requirements, and the urgency to promptly protect human rights, civil rights, and the legitimate rights and interests of individuals, and prevent widespread violations of personal data as they are today. At the same time, it creates synchronization, unity, and consistency of the legal system, serving the breakthrough revolution in science and technology development, innovation, and national digital transformation.

Delegates also suggested considering more appropriate penalties for violations of personal data protection regulations; simplifying administrative procedures to reduce the burden of compliance costs for businesses; ensuring a balance between personal data rights and personal data protection issues in ensuring security and order; and researching appropriate personal data storage...

Concluding the discussion, Vice Chairman of the Committee for National Defense, Security and Foreign Affairs Nguyen Minh Duc highly appreciated the opinions expressed; stating that this is important information on scientific, legal and practical basis, helping the Standing Committee of the Committee in the process of receiving, revising and perfecting the draft Law on Personal Data Protection.
