Quang Nam considers legal restoration for Le Phan Eco-tourism Area

Le Phan Eco-tourism Area continues to encounter difficulties, Quang Nam province assigned the Department of Finance to study and consider restoring legal investment for this project that has lasted for more than 20 years.

Vice Chairman of Quang Nam, Mr. Phan Thai Binh, has just continued to direct the resolution of problems at the Le Phan Eco- tourism project in Cam An ward, Hoi An city.

Accordingly, the leaders of Quang Nam province requested departments, localities and investors to seriously learn from experience in implementing previous instructions on the project of the Provincial People's Committee.

To provide investors with a basis for implementation, Quang Nam Vice Chairman Phan Thai Binh assigned the Department of Finance to urgently research and consider restoring the investment legality of the Le Phan Eco-tourism project.

The investor is responsible for promptly establishing a project management and operation unit in Quang Nam province; fully implementing related procedures to fulfill financial obligations to the State regarding project implementation guarantee deposits, land rent, taxes, etc.

Regarding the determination of land rent and tax, the Vice Chairman of Quang Nam assigned the Department of Agriculture and Environment to preside over the review and determination of the time of land allocation, scale and area of ​​the Project to re-determine land rent and tax... to ensure compliance with regulations, as a basis for investors to fulfill their obligations and responsibilities to the State, before carrying out the documents and procedures for adjusting the Project according to regulations...

Le Phan Eco-tourism Area is located in Cam An ward, Hoi An city.

The Le Phan Beach Resort project has lasted for more than 20 years. In 2005, Le Phan Resort Joint Stock Company was assigned land by Quang Nam province, leasing land with a total area of ​​43,000m2, to implement the Le Phan Beach Resort project.

Quang Nam Province then decided to reclaim the land, because it believed that this enterprise had violated land laws. Le Phan Resort Company complained. The Ministry of Natural Resources and Environment then concluded that Quang Nam Province's decision to reclaim Le Phan Resort Company's land before the 24-month extension period for land use progress had expired was not in accordance with legal regulations.

Quang Nam Province had to decide to extend the land use period of Le Phan Resort Company for the area of ​​35,000 m2/39,120 m2 of completed site clearance. By October 2022, Quang Nam Province agreed to extend the progress of putting the land into use of the project due to the impact of the Covid-19 epidemic.

Quang Nam Province then decided to adjust the land lease area and land allocation of the project. In particular, the leased land area was adjusted down to 31,715m2, down 7,404m2 from the area of ​​39,120m2 according to the previous decision; the land allocation area without land use fee collection was reduced to 3,408.4m2.

Hoi An City has also handed over land to Le Phan Resort Company, with an area of ​​35,124m2 that has been cleared. At the same time, the adjusted area of ​​7,876m2 from the Cam An Ward Beach Tourism Area project was handed over to Hoi An City People's Committee to recognize residential land for households and individuals and serve local socio-economic development.

However, up to now, this project is still stuck and cannot be implemented.
