The Department of Education and Training issued important instructions regarding signing labor contracts in schools.

(NLDO) - The Department of Education and Training of Ho Chi Minh City has just issued instructions for units to implement contract signing according to the provisions of Decree No. 111/2022 of the Government.

According to the Department of Education and Training, group 2 units are public service units that self-finance regular expenses. Group 3 units are public service units that partially self-finance regular expenses.

For contracts to perform support and service work: Public service units sign contracts to perform support and service work according to the provisions of Decree No. 111/2022 of the Government regulating contracts for certain types of work in administrative agencies and public service units and Circular No. 05/2023 of the Ministry of Home Affairs guiding the form of service contracts and form of labor contracts for certain types of work in administrative agencies and public service units.

For contracts to perform professional and technical work: Public service units sign contracts to perform professional and technical work in the list of specialized job positions and specialized job positions commonly used in public service units, specifically:

Basis and authority to determine the number of contract workers

For group 2 units: Public service units that self-insure regular expenses sign labor contracts to perform specialized and professional work in job positions held by civil servants according to the unit's human resource needs.

For group 3 units: The basis for determining the number of contract workers signed to provide public career services without using the state budget includes: The norm of the number of employees in the units according to the circulars prescribed by the Ministry of Education and Training; the number of employees receiving salaries from the budget and career revenue sources assigned by the Department of Education and Training in the year and the level of financial autonomy of the unit.

Based on the above bases, the unit determines the number of employees with contracts to provide public career services not using the state budget signed in the year as the difference between the number of assigned employees and the number of employees according to the norms prescribed in the circular of the Ministry of Education and Training.

Authority to decide on the number of contracts to provide public career services not using the state budget:

For units that self-insure from 70% to less than 100% of regular expenses: The head of the unit shall decide the number of labor contracts based on the number of labor contracts and the unit's ability to pay.

For units that are self-insured under 70% or have not been granted financial autonomy: The head of the unit reports to the Department of Education and Training for approval before implementation.

Group 3 units that still have the number of employees assigned by the competent authority must recruit the assigned number.

The term of the contract shall be one of the following types: Fixed-term labor contract, in which the two parties determine the term and termination date of the labor contract within a period not exceeding 36 months from the effective date of the contract. Indefinite-term labor contract.

Implementation costs for group 2 units: Contract implementation is guaranteed from the unit's self-guaranteed funding source according to the provisions of law on financial autonomy mechanism of public service units.

Group 3 unit: Use revenue from career activities to perform contracts; state budget support if any, ensuring not to increase total regular expenditure from state budget sources according to regulations.
