On the morning of June 3, continuing the 46th Session, the National Assembly Standing Committee gave opinions on the reception, explanation, and revision of the draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations; the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality.

Minimize administrative procedures and costs for businesses

Reporting on the explanation, acceptance and revision of the draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations, Chairman of the National Assembly's Committee on Science , Technology and Environment Le Quang Huy said that conformity declaration is a necessary and important measure and tool to ensure effective state management, protect consumers, and enhance the brand of enterprises, and should not be eliminated.

In response to the opinions of National Assembly deputies, in order to overcome the duplication in conformity assessment activities, which causes costs for enterprises (due to having to comply with the regulations on conformity declaration according to the Law on Standards and Technical Regulations, and having to comply with the requirements of specialized laws), the draft Law has stipulated the expansion of the common use of conformity assessment results as a basis for conformity declaration activities; exempting conformity declaration for goods and products that fully meet the quality management requirements according to the provisions of specialized laws so that enterprises only have to comply with one process, instead of having to carry out two processes as at present.

To minimize administrative procedures and costs for businesses, and promote digitalization of procedures for registration of conformity declarations, the draft Law has revised regulations on conformity registration in a simplified manner, whereby organizations and individuals only need to notify conformity declarations on the national database of standards, measurements, and quality.

Chairman of the Delegation Working Committee Nguyen Thanh Hai proposed to maintain the regulations on conformity declaration and adjust the content of conformity declaration procedures in the direction of reviewing and updating the system of standards quickly and in harmony with international standards. In particular, the conformity declaration process must be electronicized.

According to Ms. Hai, the regulation on conformity declaration has many benefits, such as ensuring product quality and safety (especially for goods that affect health and the environment), protecting consumers, creating a level playing field, avoiding commercial fraud, etc.

"Incidents such as fake milk, fake rice, and fake medicine show that product quality associated with protecting consumer rights, protecting people's health and lives needs to continue to receive special attention. Therefore, it is impossible to abolish the declaration of conformity," the Chairman of the Delegation Work Committee emphasized.

National Assembly Chairman Tran Thanh Man said that National Assembly deputies are very interested in this draft Law because it is related to the current assessment of food safety, when inspection forces are everywhere across the country, to ensure product standards, technical regulations, etc.

"When counterfeit, fake, imitation, and poor quality goods occur, no agency takes primary responsibility. When we issue this law, we must clarify the responsibilities of the National Assembly, the Government, and relevant ministries and branches in order to handle it," the National Assembly Chairman pointed out.

According to the National Assembly Chairman, the Law needs to focus on increasing transparency, feasibility and mobilizing the participation of enterprises in the development and application of standards and regulations for unified management, in accordance with international commitments and practices. Along with that, the Government urgently completes related decrees so that after the law is passed, it will soon take effect.

Improve the efficiency of monitoring product quality

Discussing the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality on the morning of June 3, delegates proposed that the regulations on principles for classifying and managing product and goods quality should be easy to understand, easy to do, and easy to implement.

At the same time, review and clarify the responsibilities of relevant ministries and branches in licensing production, import and quality control of goods; assign a leading agency to take full responsibility in this process, instead of dispersing responsibility.

According to the Report on explanation, acceptance and adjustment of the examining agency, the draft Law has added a provision that for high-risk products and goods, traceability is mandatory, determined by the Ministry managing the industry and sector, and has a roadmap for implementation, ensuring feasibility, suitability with the capacity of enterprises and the development characteristics of each industry.

The remaining products (goods with medium and low risk levels) are not required to apply traceability regulations.

The Draft Law has added regulations on product quality surveys, establishing a legal basis for product quality surveys to detect early signs of violations, risks of unsafety or non-conformity in the market, supporting warnings, adjusting policies and improving the effectiveness of monitoring product quality in the market, as a basis for focused post-inspections./.
