Strengthening support for post-bankruptcy businesses associated with transparency and integration

On October 23, continuing the 10th Session, the National Assembly discussed in groups the draft Law on Bankruptcy (amended), Law on Deposit Insurance (amended), Law on Disease Prevention, Law on Press (amended) and Law on Population.

Creating a legal framework for recovery procedures

Discussing in groups after listening to the report on the draft Bankruptcy Law (amended) in the hall, delegates agreed that the draft Law has overcome the limitations of the current law, especially in reducing cumbersome and inappropriate procedures, increasing support for post-bankruptcy business recovery, and expanding the scope of application to include bankruptcy of individuals and foreign businesses.

Regarding the above provisions on recovery support, delegate Le Minh Nam (Can Tho Delegation) commented: This is a policy that demonstrates the humanity and flexibility of the law to ensure the harmony of interests between businesses, creditors, employees and the economy . However, it is necessary to carefully consider to optimize the effectiveness and feasibility of recovery support to avoid wasting opportunities, negatively affecting resources for recovery activities or, more worryingly, causing unnecessary costs, increasing damage to related parties compared to applying bankruptcy procedures immediately.

Commenting on the draft Bankruptcy Law (amended), National Assembly Chairman Tran Thanh Man highly appreciated the strengths and breakthroughs in procedures for restoring independent business operations, shortening processing time, applying digital technology , and improving the effectiveness of support mechanisms from the State...

However, the drafting agency needs to continue to coordinate with the auditing agency to perfect regulations related to prioritizing independent recovery, avoiding bankruptcy evasion, causing loss of assets or affecting the rights of creditors, negatively impacting the state budget.

Regarding the regulations on jurisdiction and disputes, National Assembly Chairman Tran Thanh Man expressed concern that assigning courts to resolve all related disputes could lead to overlaps with current laws. Meanwhile, the regulations on synchronous asset sales still lack some detailed provisions, which can easily cause delays in asset handling. Regarding the quality of administrators, the National Assembly Chairman said that it is necessary to strengthen training, professionalization, and clearly stipulate types of certificates, international or equivalent training programs for administrators...

Discussing in groups, Vice Chairman of the National Assembly Nguyen Khac Dinh and a number of delegates expressed their approval of the proposal to change the name of the Law project to "Law on Rehabilitation and Bankruptcy", and at the same time fundamentally change the content of the Law project in this direction.

According to the Vice Chairman of the National Assembly, the draft Law needs to change the mindset and understanding that society has had up to now that filing for bankruptcy is not a good thing. Meanwhile, in the international market, filing for bankruptcy can still be rehabilitated, only when every effort has been made but recovery is still not possible, then bankruptcy is allowed to protect the interests of related parties, towards a healthy economy.

Increase the presence of local multi-media key media agencies

Emphasizing the role of the press in leading and orienting public opinion, delegate Thich Duc Thien (Dien Bien Delegation) suggested that it is necessary to clarify the management mechanism of press activities in cyberspace.

Regarding the press economy, many delegates said that this is an issue that needs utmost attention in the context of declining revenue sources for press agencies and increasingly fierce competition. Therefore, it is recommended that the State increase investment in key press agencies to ensure their role in guiding and leading public opinion, communicating policies and maintaining the principles and goals of revolutionary journalism.

At the same time, the Law should also expand the legal framework for forms of association, socialization, public-private partnership in the press, with breakthrough preferential policies on tax, land, credit access, etc. for press agencies, including with associated partners when organizing cultural events, community activities, etc. Along with that is a strict control mechanism to avoid commercialization, deviating from the principles and purposes.

Delegate Nguyen Thi Mai Thoa (Hai Phong Delegation) said that the new regulations on revenue sources are expected to help press agencies increase their autonomy and resolve economic difficulties in the press.

Delegate Bui Hoai Son (Hanoi Delegation) said that the draft Law not only creates a legal framework for press activities, but also paves the way for press to develop as a modern cultural industry. When the press is placed in the cultural industrial ecosystem, we can create a large value-added chain that both serves political tasks and contributes to economic growth and promotes the national image.

Delegate Bui Hoai Son cited the fact that the press can completely become the core of large-scale cultural and creative events such as: VTV successfully organized the V Concert - Radiant Vietnam and V Fest - Glorious Youth at the Vietnam Exhibition Center, which were not only performance events but also media and cultural products that spread strongly on both television and digital platforms. Nhan Dan Newspaper organized the concert "Fatherland in the Heart" at My Dinh Stadium, gathering tens of thousands of spectators, both affirming the role of revolutionary journalism in inspiring patriotism and opening a new model for the press to participate in developing the performance industry.

Giving opinions on the Law on Disease Prevention, delegates said that the development and promulgation of the Law on Disease Prevention is an important step to change the mindset from "treatment" to "disease prevention", improving the health of the whole population.

Regarding prohibited acts in disease prevention activities, specifically concealing, failing to declare or failing to promptly declare cases of infectious diseases as prescribed by law, delegate Nguyen Manh Hung (Can Tho Delegation) also wondered about what is considered failure to declare promptly.

According to the delegate, the failure to report in a timely manner could have many causes such as: the emergence of new diseases that have not been clearly identified or the limited understanding and awareness of infectious diseases among the people. Therefore, the delegate suggested that the drafting committee should research and clarify this issue further.

In addition, delegate Nguyen Manh Hung and many other delegates agreed with the draft Law dedicating a separate article to regulating disease prevention in educational institutions, however, in crowded areas such as industrial parks, factories and even hospitals and medical facilities with high risk of disease transmission, it has not been mentioned...
