At a recent meeting of the Steering Committee for reviewing and organizing the implementation of handling difficulties in the legal system, Deputy Minister of Justice Nguyen Thanh Tu said that ministries, branches and localities had to review up to 19,224 documents related to the functions, tasks, powers, organization and operation of local governments. This is a huge number, reflecting the complexity of the reform process and the challenges that the Government, ministries and branches are facing.
The current reform orientation opens up new development space, but also raises many issues arising in the management work. For example, the key in organizing local government according to the two-level model (province - commune) is to define authority. When the district level is abolished, how will the authority of this level be transferred to the province or down to the commune level? When localities establish new provincial and commune-level apparatuses, they need to clearly understand which level will assume the authority previously held by the district level, what authority will the province have, what authority will the commune have, and what will the Central Government delegate to the province level? These questions need to be discussed; clarified - before "institutionalizing" by including new legal regulations.
It can be said that reviewing and determining solutions to the issues in 19,000 legal documents is an unprecedented task. The time allotted for this task is also extremely urgent. According to the request of the Government leaders, the documents submitted to the National Assembly at the upcoming May session must be completed and submitted to the Government before April 6. Therefore, this work requires the highest efforts of each ministry, branch, and locality; close coordination between these units; as well as unified direction from the Central Government.
Recently, the Ministry of Justice has established a working group on receiving and handling feedback and recommendations to improve the law; built an information system for receiving and handling feedback and recommendations on legal documents for trial operation. After reviewing, the Ministry of Finance discovered that 195 legal documents need to be revised; the Ministry's leaders said that units under the Ministry are working day and night, including weekends. The Ministry of Agriculture and Environment also affirmed that "we can only discuss and do, we cannot discuss back".
On the National Assembly side, National Assembly Chairman Tran Thanh Man asked the National Assembly Standing Committee to closely coordinate with the Nationalities Council and the National Assembly Committees, urgently deploying work in the spirit of "running while lining up" to ensure the success of the session "which is of important and historic significance; the amount of work is very large".
The documents reviewed and revised this time are not only “technical” regulations but also operational tools of the state apparatus. Amendments, supplements or repeals must ensure rationality, coherence and not create legal gaps in state management. This requires the authorities not only to work at a fast pace, but also to have a systematic mindset, to view the problem comprehensively to avoid overlap and conflict between levels of government.
This task is not simply to amend some legal regulations, but also an opportunity for comprehensive institutional reform. If implemented well, our country will have a strict, unified, modern legal system, suitable for a streamlined and effective management model. This will not only help the state apparatus operate better, but also create a favorable legal environment for socio-economic development, enhancing the trust of people and businesses in the transparency and effectiveness of public policies.
