Law amendments must untie the knots
On May 28, continuing the 9th Session, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Planning.
Participating in the meeting, delegate Ta Van Ha ( Quang Nam delegation) raised the issue of amending the law many times but still could not untie the knots.
Delegate Ta Van Ha emphasized that the previously issued Planning Law had the spirit of transforming planning methods, fundamentally changing planning such as local division by field, determining planning to be multi-sectoral, comprehensive and interconnected.
However, according to Mr. Ha, the actual implementation has not met the requirements because the implementation team has not yet grasped the spirit of innovation and new ways of doing things, so the approach and coordination are not familiar. Mr. Ha said, "When implementing planning in a new spirit, a new "conductor" is needed, but currently there is still no experienced, seasoned, visionary conductor to link the plans together. Currently, we do not have such a conductor, leading to many obstacles when implementing".
Another content in the draft law is the addition of a principle allowing national planning, regional planning and provincial planning to be made simultaneously. However, delegate Ta Van Ha is concerned that this could lead to conflicts and overlaps in development space, goals, targets... and parallel implementation of plans.
"We have to find the right cause, not fix it and still get stuck. I think we basically have to be calm and consider this issue," said delegate Ta Van Ha, emphasizing that if we have not fully recognized and are not familiar with the changes, we need to review them carefully, because only with truly fundamental changes can we solve the planning problem.
Delegate Nguyen Quang Huan said that it is necessary to boldly review the Law on Planning comprehensively.
Sharing the same view, delegate Nguyen Quang Huan ( Binh Duong Delegation) said that the Planning Law was drafted in 2017 but was only implemented in 2020 and since its implementation, there have been many issues that need to be considered.
By 2022, the National Assembly issued Resolution 61, which raised many planning issues and required the Government to comprehensively assess and comprehensively amend the Planning Law.
Mr. Huan said that after that, there were a few revisions, but mainly the chapters and articles that were still causing problems. However, if only a few chapters and articles were revised, Mr. Huan said that it would not solve the fundamental problem.
Delegate Nguyen Quang Huan said that it is necessary to boldly review the current Planning Law to see how feasible it is, especially the provincial planning when merging provinces in the future. He gave an example, 3 provinces and cities, namely Ho Chi Minh City, Ba Ria-Vung Tau, Binh Duong, have had their planning approved, and when merging these 3 provinces and cities together, it is impossible to apply the method of combining 3 plannings into a new planning.
The Binh Duong delegation emphasized that merging provinces is to create new development space. "But when creating new development space, the input data has changed, so the output data of each previous provincial planning cannot be applied."
In addition, according to Mr. Huan, other laws such as the Construction Law also have very detailed regulations on sectoral planning and there is overlap. "There are localities with very large land funds, the Prime Minister has approved the use of land for planning but for the past 10 years it has not been done. Most recently, when asked, they are still waiting for the establishment of a Council to appraise the planning task, this will take about 6 months to 1 year. So we are wasting a lot of resources," Mr. Huan said.
Removing difficulties and obstacles to implement projects to meet the requirement of 8% growth
Explaining the opinions of National Assembly deputies, Minister of Finance Nguyen Van Thang stated that the Law on Planning should be amended to continue to remove difficulties and obstacles to implement projects to meet the requirement of 8% growth in 2025.
Minister of Finance Nguyen Van Thang emphasized the need to urgently amend the law, focusing on three major issues at hand, while other issues will continue to be completed in the coming time to move towards a comprehensive amendment. "So why is it necessary to urgently amend this law and focus on three major issues? There are many issues raised by National Assembly deputies, we will amend in the coming time to be more comprehensive," said the Minister.

Specifically, according to Minister Nguyen Van Thang, the Law on Planning will be amended to ensure immediate adjustment of planning at all levels. After the Resolution on merging provincial administrative units takes effect, localities will have to immediately adjust their planning.
At the same time, the law must also ensure the principle that plans being implemented will continue to be implemented until the adjusted plan takes effect. This is to avoid disruption in management and investment.
Along with that, this law amendment focuses on promoting decentralization, maximum delegation of power, enhancing autonomy, proactiveness, creativity and self-responsibility for all levels and sectors.
The Minister emphasized that this is especially important in the context that many localities are implementing a two-level government model.
In response to concerns from National Assembly delegates about whether "such decentralization can be guaranteed", Minister Nguyen Van Thang stated his opinion: "This is a situation where we must do it. If we do not follow the process and submit it to the Government to submit to the National Assembly, we do not know when the locality will be able to do it."
Minister Nguyen Van Thang especially emphasized that the draft law was developed to immediately remove practical difficulties and obstacles to promptly implement projects to serve the growth target of 8% in 2025.
"This is the main reason why we must urgently amend the Planning Law this time," Minister Nguyen Van Thang affirmed. "In the long term, the Government will submit it to the National Assembly for comprehensive amendments."
Minister Nguyen Van Thang frankly admitted that the Law on Planning has been "very problematic" since its promulgation. Therefore, when carrying out comprehensive revisions, it is necessary to boldly review, keep what is necessary, and remove what is no longer appropriate.
