Removing obstacles in the Chi Cong Concentrated Aquatic Seed Production Area project

On October 30, 2013, the Ministry of Agriculture and Rural Development (now the Ministry of Agriculture and Environment) approved the Chi Cong Concentrated Aquatic Seed Production Area Project (phase 1) with a scale of 90 hectares and a total project investment of more than 127 billion VND.

This is a key project, aiming to attract businesses and economic organizations with technological and financial potential, with experience in high-tech shrimp seed production, associated with creating land funds to relocate shrimp seed production facilities in the area affected by Vinh Tan Thermal Power Center in production.

Land not yet leased

However, this project still faces many difficulties, so although it has been implemented for a long time, the project still has 1,744 m² of land that has not been handed over out of a total of 905,144 m² of recovered land. In order to manage and exploit the project after investment, policies for investment incentive sectors, the Provincial People's Committee issued Decision No. 504/QD-UBND dated February 12, 2018 approving the Project "Management and exploitation of the Chi Cong Concentrated Aquatic Seed Production Area, Phase 1" (Project 504). On that basis, the Department of Agriculture and Environment has publicly announced the content of the Project for organizations and individuals to register their demand for land lease to invest in shrimp seed production. In 2019 - 2020, the Provincial People's Committee has agreed on the location according to the planning to divide plots for 5 enterprises to carry out investment procedures and establish investment projects for high-tech shrimp seed production. However, up to now, the projects have not yet had a decision on land lease.

It is known that previously, the departments and branches advised to apply the mechanism of "State land lease without land auction" for shrimp seed production investment projects in the Chi Cong Concentrated Aquatic Seed Production Area, Tuy Phong District at the time of promulgation of Project 504, which was based on the provisions of the Investment Law 2014, the Land Law 2013 and current policies applied to industries with special investment incentives and investment incentive areas. “However, according to the opinions of departments and branches at the meeting on May 16, 2024 at the Provincial People's Committee, this project is compensated by the State, land is recovered (clean land) and infrastructure investment is from the State budget (Central capital and provincial budget); the project does not belong to the types of "Industrial cluster", "Industrial park", "Economic zone" for which the Government has specifically regulated the management of infrastructure, exploitation and use of land funds formed after investment. Therefore, it is necessary to carefully review the legal regulations applicable to the management and exploitation of the Chi Cong Concentrated Aquatic Seed Production Area project (phase 1) invested from the State budget, in which legal regulations on management and use of public assets should be carefully studied when considering and resolving investment projects using land in this project", said the leader of the Department of Agriculture and Environment.

Adjustment of Project 504

On the other hand, Notice No. 811 TB/VPTU dated October 24, 2024 of the Provincial Party Standing Committee on the Conclusion of the policy of extending the operation period of shrimp projects in Tuy Phong district has directed the review and arrangement of relocation of shrimp farming facilities in Vinh Tan commune to Chi Cong Concentrated Aquatic Seed Production Area. In the process of synthesizing the demand for land for shrimp seed production, many organizations and individuals registered in excess of the planned area for shrimp seed production of Project 504. Therefore, organizing an auction of land use rights to implement the investment project is appropriate. For the above reasons, it is necessary to review and adjust the content of Project 504 to ensure compliance with current legal regulations, the actual situation, and effectively implement the project's objectives according to the opinion of the Ministry of Agriculture and Environment.

Recently, the Provincial People's Committee held a meeting with departments and branches to listen to reports on Project 504. The purpose of adjusting Project 504 is to ensure the organization of management, use, exploitation and promotion of technical infrastructure of Chi Cong Concentrated Aquatic Seed Production Area, Phase 1 in accordance with the project objectives, in accordance with the law and State policies on encouraging the development of aquatic seed production. Ensure attracting enterprises and investors to produce high-tech aquatic seeds, meeting national technical standards and regulations, strong in finance and technology, large-scale investment, high competitiveness associated with the rearrangement of aquatic seed production facilities in the locality according to the planning, forming a large concentrated aquatic seed production and supply center of the region and the whole country.

At the meeting, Vice Chairman of the Provincial People's Committee Nguyen Hong Hai requested the Department of Agriculture and Environment to coordinate with relevant departments, branches and localities to review the compensated land area compared to the land area handed over to the investor to have a basis for effective land management. Review the results of the implementation of Project 504 in the past time and the difficulties and obstacles; from there, propose to adjust some contents of Project 504 based on current legal regulations. The Department of Agriculture and Environment has a document advising the Provincial People's Committee to report to the Ministry of Agriculture and Environment to guide and support Binh Thuan province to implement this model in accordance with current legal regulations, to improve the investment efficiency of the project. At the same time, review the legal regulations, in case it is necessary to implement the 1/500 planning, it must be implemented immediately to update the infrastructure and subdivision planning; on that basis, call for investors or bid and auction to implement the project.

Tuy Phong currently has 111 projects and production facilities with 725 shrimp hatcheries. Of which, 42 projects with a land use area of ​​over 156 hectares have been granted investment certificates by the province, the remaining facilities are households and individuals registered to do business to produce shrimp. The average shrimp hatchery output is 25 billion post larvae/year, accounting for 80% of the shrimp hatchery output of the whole Binh Thuan province.
