Removing obstacles in licensing and exploiting minerals for common construction materials

Accordingly, the Chairman of the Provincial People's Committee requested the Department of Finance to focus on resolving and removing obstacles in approving investment policies for mineral exploitation projects for common construction materials in the province, especially for Group IV minerals (filling land). Advise the Chairman of the Provincial People's Committee to report and propose competent authorities to consider adjusting and supplementing the Bac Ninh Provincial Planning (new) according to regulations, including the content of adjusting and supplementing common construction material mineral mines (soil, stone, sand and gravel) to serve the construction of projects and construction works in the province.

The Department of Agriculture and Environment shall preside over and advise the Chairman of the Provincial People's Committee to issue and adjust the content of mining licenses for mineral mines (fill soil, sand and gravel) in the province that have ensured the conditions according to regulations, to be completed before August 31, 2025.

Continue to implement the Plan for auctioning the right to exploit minerals for common construction materials in Bac Giang province in 2025, approved by the Provincial People's Committee in Decision No. 805/QD-UBND dated June 28, 2025.

Focus on reviewing and advising the Provincial People's Committee to demarcate, approve, and adjust areas where mineral exploitation rights are not auctioned in the province according to regulations. Resolve recommendations and remove some difficulties and obstacles in the implementation after granting mineral exploitation licenses.

The Chairman of the Provincial People's Committee also agreed in principle to allow mineral mines (filling soil, sand and gravel) that have been granted mining licenses before July 1, 2025 through the form of not auctioning mineral exploitation rights in Bac Giang province (old), which are still in effect, to be provided for projects using the state budget (traffic works, irrigation works), urgent public investment projects, works, and construction items under the national target program in Bac Ninh province, without having to carry out procedures to adjust and supplement this content in the mineral exploitation license previously granted.

Regarding land use in mineral exploitation activities, the Official Dispatch clearly states that it agrees in principle on the content of removing obstacles for land use in the exploitation of Group IV minerals (land fill) in the direction of not having to carry out procedures for land recovery, land use purpose conversion, and land lease. However, the mine owner must have a civil agreement with households and individuals with land use rights in the project area on permission for mineral exploitation (land fill) during the licensed period. In addition, households and individuals with land use rights must pay personal income tax and other related financial obligations for the amount of money earned from the civil agreement with the mine owner for mineral exploitation.

The Department of Agriculture and Environment shall preside over and continue to coordinate with the Department of Construction and relevant agencies to research, explain and clarify the legal basis and legal provisions for the content of the proposal to allow mineral mines (soil, sand and gravel) to open public roads (temporary roads) to serve mineral exploitation without having to carry out project investment procedures, procedures for changing land use purposes, changing forest use purposes, however, after the end of exploitation, it is necessary to carry out environmental and land rehabilitation and restoration according to regulations; the implementation results shall be reported to the Chairman of the Provincial People's Committee before August 15, 2025.
