This Resolution applies to agencies, units, enterprises, organizations and individuals involved in the development, management, use and ownership of social housing.
According to the Resolution, the National Housing Fund is a non-budgetary state financial fund with legal status and operates not for profit.
The national housing fund includes the central housing fund established by the Government and the local housing fund established by the provincial People's Committee. The national housing fund is formed from the state budget, money deducted from the amount equivalent to the value of the land fund invested in building technical infrastructure systems to build social housing according to the provisions of the law on housing, from the proceeds from selling public housing, from the proceeds from auctioning land use rights according to the provisions in Point b, Clause 4, Article 12 of this Resolution; receiving voluntary support sources, contributions from domestic and foreign organizations and individuals, and other legally mobilized sources.
National housing fund for investment in social housing construction, investment in construction of technical infrastructure, social infrastructure of social housing construction investment projects, creation of social housing for rent, housing for officials, civil servants, public employees, and workers to rent.
The National Assembly also decided to assign investors, approve investment policies, and assign investors without bidding for investment projects to build social housing and housing for the people's armed forces that do not use public investment capital.
Regarding the procedures for establishing, appraising, approving, and adjusting detailed planning for social housing construction investment projects, construction investment projects, and land locations for social housing construction investment that do not have detailed planning approved by competent authorities or require adjustment of detailed planning, it is not necessary to carry out procedures for establishing, appraising, approving, and adjusting detailed planning tasks.
The preparation, appraisal, approval and adjustment of detailed planning are carried out in accordance with the provisions of law on urban and rural planning.
Social housing construction investment projects do not have to conduct appraisal of construction investment feasibility study reports at specialized construction agencies according to the provisions of the law on construction. Investors and investment decision makers shall organize appraisal and approval of feasibility study reports themselves and are responsible for ensuring compliance with the provisions of the law on construction.
Determining the selling price and lease-purchase price of social housing is carried out for one or several works of a social housing construction investment project according to the implementation phase or investment period, each component project or the entire project.
Housing conditions to enjoy social housing support policies are stipulated as follows: for provinces and centrally-run cities that are rearranged, based on the scope of the administrative unit of the province or centrally-run city where the project was located before the time of rearrangement, housing conditions for subjects eligible to buy or rent-purchase social housing are determined according to the provisions of the Housing Law.
In case the beneficiaries of social housing support policies according to the provisions of the law on housing have a workplace far from their place of residence, the housing conditions for being eligible to buy or lease social housing are: not having purchased or leased social housing, not having a house of their own or having a house of their own but far from their place of work. Based on the actual conditions of the locality, the Provincial People's Committee shall specify in detail the cases where the beneficiaries of social housing support policies are those who own a house but far from their place of work.
This resolution is implemented for 5 years, starting from June 1, 2025.
From the date this Resolution ceases to be effective, the National Housing Fund established under Article 4 of this Resolution shall continue to operate until new regulations are issued by the competent authority.
From the date this Resolution expires, social housing construction investment projects that are implementing specific mechanisms and policies according to the progress recorded in the investment project shall continue to be implemented until the project is completed.
