Is the compensatory leave paid?

(Chinhphu.vn) - Ms. Nguyen Thi Thanh Tam (Quang Ninh) is a high school teacher, on maternity leave from May 29 to November 28, 2024. The time Ms. Tam went on maternity leave coincided with the summer vacation, so the management agency allowed her to take 12 days off in lieu.

Mrs. Tam asked, for the 12 days off, will she receive full pay or unpaid leave?

Regarding this issue, the Ministry of Education and Training responded as follows:

Pursuant to Article 3 of Decree No. 84/2020/ND-CP dated July 17, 2020 of the Government detailing a number of articles of the Law on Education , the annual summer vacation for teachers of general education institutions is 8 weeks, including annual leave.

In the case of Ms. Nguyen Thi Thanh Tam taking maternity leave from May 29, 2024 to November 28, 2024, due to the complete overlap with the summer vacation of the 2023-2024 school year, she will be entitled to take compensatory leave according to the annual leave regime and receive full salary according to the provisions of Clause 1, Article 113 of the 2019 Labor Code and the instructions in Official Dispatch No. 1125/NGCBQLGD-CSNGCB dated August 18, 2017 of the Department of Teachers and Educational Managers, Ministry of Education and Training.
