Prime Minister Pham Minh Chinh: Requires achieving 3 goals in reviewing and handling problems in the legal system

On the afternoon of September 20, concluding the sixth meeting of the Steering Committee for reviewing and handling difficulties in the system of legal documents (Steering Committee), Prime Minister Pham Minh Chinh, Head of the Steering Committee, emphasized that it is necessary to perfect the legal system, turning bottlenecks into national competitive advantages as directed by General Secretary To Lam to realize the goal of rapid and sustainable growth, achieving the country's two 100-year goals.

At the meeting, the Steering Committee listened to the draft and discussed: The implementation of the tasks set out by the 5th meeting of the Steering Committee; The results of the review of legal documents affected by the reorganization of the apparatus and recommendations; Review of draft laws, especially urgent laws being completed to be submitted to the National Assembly at the upcoming 10th session.

In particular, the Meeting listened to a report on the implementation of the Conclusion of General Secretary To Lam in Notice No. 08-TB/BCĐTW dated August 8, 2025 on continuing to perfect the review results, ensuring accurate identification of the contents of 834 difficulties and officially publicly responding to 1,237 contents, recommendations and reflections that ministries and branches agreed were not difficulties or obstacles due to legal regulations so that agencies, organizations, enterprises and individuals with recommendations and reflections could know.

Concluding the meeting, the Prime Minister acknowledged and highly appreciated the Ministry of Justice, the Government Office, and relevant ministries and branches for preparing documents for the conference in a timely, elaborate, serious, and high-quality manner; basically agreed with and highly appreciated the dedicated, responsible, focused, and key opinions of representatives of ministries and agencies.

The Prime Minister emphasized that the Politburo, the Secretariat, and General Secretary To Lam pay special attention to perfecting the legal system, turning bottlenecks into national competitive advantages to realize the goal of rapid and sustainable growth, achieving the country's two 100-year goals. Therefore, the National Assembly and the Government are actively reviewing, amending, and supplementing laws, building, and perfecting institutions.

Prime Minister Pham Minh Chinh noted that the review and handling of obstacles in the legal system must achieve three goals. These are: Reviewing and removing institutional obstacles to transform from a state of mainly administrative management to a state of development creation, serving people and businesses more effectively; carefully reviewing decentralization, delegation of authority, assignment of responsibilities, along with resource allocation, designing monitoring and inspection tools, improving implementation capacity at all levels, resolutely cutting down unnecessary administrative procedures that cause inconvenience and congestion; reviewing cumbersome administrative procedures and decentralizing and delegating more strongly in implementing the 2-level local government model, serving development creation, improving capacity to serve people and businesses.

The Prime Minister requested ministries, branches and members of the Steering Committee to closely follow the Steering Committee's Plan to implement the Conclusion of General Secretary To Lam at the Central Steering Committee's thematic meeting on perfecting institutions and laws regarding the review results, and propose solutions to remove difficulties and obstacles due to legal regulations.

The relevant parties continue to complete the review results, ensuring accurate determination of the content, plan and time for handling the contents identified as difficult and problematic due to legal regulations; give opinions on the related contents stated in Report No. 76-BC/DU and be responsible for the content, handling plan and opinions of their Ministries and branches so that the Ministry of Justice can synthesize and report to the Steering Committee at the next meeting.

The Prime Minister requested to publicly announce the official responses of the Ministries and branches on the Ministry's electronic information portal and the National Law Portal; and send them to the agencies and organizations that have reflected and recommended the contents of the recommendations and reflections in the field of state management that the review results show are not due to legal regulations. The parties proactively study and use the review results in Report No. 76-BC/DU and Report No. 287/BC-BTP to serve the task of building and perfecting the legal system according to the proposed roadmap.

The Prime Minister pointed out that the review and implementation of solutions to the discovered shortcomings and problems will be carried out according to the following principles: For the difficulties and problems in the draft laws already included in the National Assembly's law and ordinance making program in 2025, the ministries and agencies will synthesize and propose solutions immediately during the completion process and submit them to the competent authority for consideration and approval; for draft laws not yet included in the 2025 law and ordinance making program, they will be considered and added to the program for timely handling.

In case of necessity, use the mechanism in Resolution No. 206/2025/QH15 dated June 24, 2025 of the National Assembly on special mechanism to handle difficulties and problems caused by legal regulations to promptly resolve and remove institutional "bottlenecks" and "knots", ensuring growth promotion, inflation control, and macroeconomic stability.

During the period when laws and resolutions of the National Assembly have not been amended, supplemented or replaced according to the plan prescribed in Point b, Clause 1, Article 4 of Resolution No. 206/2015/QH15, the Government may issue legal resolutions to adjust a number of provisions of laws and resolutions submitted by the Government and reported to the National Assembly Standing Committee and the National Assembly at the nearest session.

For draft laws that require time for research, it is proposed to include them in the 2026 Legislative Program to ensure the goal of perfecting the legal system to meet the requirements of handling documents affected by the reorganization of the state apparatus, ensuring completion before March 1, 2027.

Regarding the results of the review, reflections and recommendations of the Party Committees of provinces, associations and enterprises sent after the Ministry of Justice has reported to the Central Steering Committee on the results of the review and proposed solutions to remove difficulties and obstacles due to legal regulations, the Prime Minister noted that the Ministry of Justice will classify and transfer them to the ministries and responsible agencies for research, acceptance and proposal of solutions for well-founded reflections and recommendations; for inaccurate reflections and recommendations, it will respond and provide guidance according to regulations.

Regarding the results of reviewing legal documents affected by the organizational restructuring (in Report No. 287/BC-BTP), Prime Minister Pham Minh Chinh assigned ministries, ministerial-level agencies, and localities to proactively and responsibly handle legal documents, ensuring timely handling of arising issues; focusing on thoroughly and effectively handling "bottlenecks" caused by legal regulations in 2025.

The Head of the Government requested that ministries and ministerial-level agencies continue to complete the results of document review, identify specific plans and roadmaps for timely handling of legal documents in the fields of state management of ministries and ministerial-level agencies, and complete them no later than October 1, 2025, to ensure the legal basis and time for localities to complete the amendment, supplementation, abolition, replacement, and issuance of new local documents before March 1, 2027; urgently review and prepare proposals for drafting laws, resolutions of the National Assembly, ordinances, and resolutions of the National Assembly Standing Committee to supplement the National Assembly's 2025 and 2026 legislative programs.

The relevant parties propose a plan and roadmap for handling legal documents affected by the reorganization of the apparatus; develop a plan to amend, supplement, abolish, replace, and issue new documents affected by the reorganization of the state apparatus in the state management field of the Ministry or agency; and send the plan to the Ministry of Justice and the Ministry of Home Affairs no later than October 15, 2025.

Provinces and centrally-run cities: Continue to update and complete the results of document review, identify specific plans and roadmaps for handling legal documents, ensuring that the handling of local documents is completed before July 2026; develop a plan to amend, supplement, abolish, replace, and issue new documents affected by the reorganization of the state apparatus of their locality; send the plan to the Ministry of Justice and the Ministry of Home Affairs no later than October 15, 2025. The Ministry of Justice monitors, urges, guides, synthesizes, and reports to the Steering Committee on the situation and results of handling legal documents affected by the reorganization of the state apparatus.

Ministries and ministerial-level agencies must closely follow the 2025 Action Plan of the Steering Committee to carry out assigned tasks; prepare documents and content for the Steering Committee's meetings to ensure progress, quality, and requirements, and in accordance with the direction of General Secretary To Lam: "We need to continue to do this well in the spirit that in 2025, we must basically remove all barriers, difficulties, and institutional problems to create a foundation for development in the coming period."

According to the Prime Minister, in order to meet the requirements of Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo, in order to effectively serve the review of legal documents, the Ministry of Justice needs to research and propose solutions to continue improving the quality and effectiveness of the Steering Committee's operations, and report to the Prime Minister and the Head of the Steering Committee for consideration and decision. The Ministry of Justice continues to monitor and urge ministries and agencies to perform assigned tasks according to the Steering Committee's 2025 Action Plan and the Prime Minister's Conclusions at the Meetings.

Prime Minister Pham Minh Chinh assigned Deputy Prime Minister Le Thanh Long, Permanent Deputy Head of the Steering Committee, to continue directing the Ministry of Justice and relevant ministries and branches to perform tasks within the scope of responsibility of the Steering Committee, reporting to the Prime Minister and Head of the Steering Committee according to regulations; ensuring a transparent legal system, smooth infrastructure, smart governance; contributing to the whole country entering a new era.

The Prime Minister noted that in the process of reviewing and handling problems in the legal system, it is necessary to closely coordinate with the agencies of the National Assembly; continue to listen to and absorb the opinions of experts, scientists, and affected subjects; selectively refer to international experiences appropriate to the conditions, circumstances, culture, political system, potential of the country and development requirements, and the requirements of the people.
