Continuing the working program of the 6th Session, on the morning of November 6, the Chief Justice of the Supreme People's Court and the Chief Prosecutor of the Supreme People's Procuracy presented a Report on the implementation of a number of resolutions of the 14th National Assembly on thematic supervision and questioning and the National Assembly's resolutions on thematic supervision and questioning from the beginning of the 15th term to the end of the 4th Session.

Innovating the court in the spirit of judicial reform

 

Presenting a report at the questioning session, Chief Justice of the Supreme People's Court Nguyen Hoa Binh said that the Supreme People's Court has directed the Courts to innovate trials in the spirit of judicial reform, promote and strengthen litigation, strictly implement the principle of independent judges and juries and only obey the law; coordinate well with the agencies conducting the proceedings and relevant agencies to ensure unity in the perception of law enforcement; promptly and strictly bring to trial, and apply severe punishment to the masterminds, ringleaders, and those who abuse their positions and powers to appropriate State assets.

 

Regarding improving the quality of handling and adjudicating all types of cases, from October 1, 2020 to June 30, 2023, the Courts accepted 1,450,770 cases; resolved 1,276,435 cases, reaching a rate of 88%.

 

The rate of judgments and decisions annulled or amended due to subjective reasons by the Court each year meets the National Assembly's target (no more than 1.5%).

 

"The trial of criminal cases is guaranteed to be strict, with the right person and the right crime being committed. There have been no cases of wrongful conviction of innocent people or letting criminals escape," said Chief Justice Nguyen Hoa Binh.

 

The Courts have resolved and tried 95% of criminal cases (exceeding the target assigned by the National Assembly by 7%); 86% of civil cases (exceeding the target assigned by the National Assembly by 8%); and 77.65% of administrative cases (exceeding the target assigned by the National Assembly by 17.65%).

The Courts have focused on mediation and dialogue; limited the time limit for cases to be overdue; coordinated with the Procuracy at all levels to organize 37,281 trial sessions to gain experience; since then, the rate and quality of resolving and adjudicating cases have continuously increased over the years.

 

There has been progress in handling requests for review and retrial. In 2022, the rate of handling requests for review and retrial by the Court system exceeded the target assigned by the National Assembly by 2.4%...

 

Courts actively organize online trials; as of June 30, 2023, 682 Courts have organized online trials for 8,381 cases, contributing to speeding up the progress of case settlement, creating favorable conditions and saving costs for related parties when participating in litigation.

 

Through online trials, total costs have been saved, estimated at about 45 billion VND.

 

The rate of judgments and decisions on administrative cases that were annulled or amended due to subjective reasons by the Court has not met the target set by the National Assembly; the number of staff has not met the requirements of the task, and has not been increased in proportion to the increase in authority and tasks of the People's Court; the facilities, equipment, and working conditions of some units and Courts have not fully met the work requirements, especially the implementation of the Law on Dialogue Mediation and online trial organization...

 

Annually allocated state public investment capital only meets about 50% of investment needs; annual funding for headquarters maintenance and repair is still low.

 

Some local courts have not paid attention to coordinating well with relevant agencies in the process of implementing tasks; some court officials have not strictly followed public service discipline, leading to disciplinary action...

 

In the coming time, the Supreme People's Court has identified solutions that need to be focused on directing implementation, including: directing the Court system to implement solutions of Resolution No. 27-NQ/TW on judicial reform; continuing to effectively implement 17 breakthrough solutions to speed up progress and improve the quality of handling and adjudicating all types of cases and other aspects of work; promoting judicial administrative reform; continuing to innovate management, direction and operation methods; building and perfecting institutions; paying attention to training and fostering professional skills to improve professional capacity; promoting the application of information technology and digital transformation of the Court; closely coordinating with relevant litigation agencies and organizations in the process of implementing all aspects of the Court's work.

Regarding the field of prosecution, Chief Justice of the Supreme People's Procuracy Le Minh Tri said that in order to effectively implement directives and resolutions of the Party and resolutions of the National Assembly, and ensure better performance of the functions and tasks of the sector, he has directed the entire sector to synchronously implement many solutions.

Specifically: Innovate and improve the effectiveness of management, direction and operation; focus on directing professional measures to ensure better implementation of functions and tasks as prescribed by the Constitution and laws, especially the task of fighting injustice, mistakes, and preventing criminals from escaping; strengthen the work of building, guiding law enforcement and judicial reform.

 

Breakthroughs in the application of information technology and digital transformation in the industry are the "leverage" to overcome limitations in management, direction, and statistics, storage, and ensure effective exploitation and use of data to serve professional work.

 

In addition, continue to expand international cooperation; innovate emulation and reward work; promote propaganda work; strengthen the management of public finance and assets.

 

The practice of the right to prosecute and supervise judicial activities has had many positive results, with basic indicators exceeding the requirements in Resolution No. 96 of the National Assembly. In particular, the rate of people arrested, detained and then transferred for criminal proceedings reached 99%; the number of cases prosecuted by the Procuracy on time reached 100% and the number of defendants prosecuted by the Procuracy with the correct charges reached 99.99%.

 

The Procuracy promptly detected violations of the law and issued many recommendations requiring the correction of violations and crime prevention, with an acceptance rate of 98.6%; the rate of appeals, final appeals, and retrials of criminal cases accepted by the Trial Council exceeded the requirements in Resolution No. 96 of the National Assembly.

 

The criminal investigation work of the Supreme People's Procuracy's Investigation Agency has achieved many positive results, discovering, prosecuting, and investigating many cases that have received public approval and high appreciation, contributing to building a clean and strong judicial system.

 

Besides, Director Le Minh Tri also pointed out some difficulties and challenges.

 

Many new provisions of the judicial laws have come into effect, but the awareness among the prosecuting agencies is still inconsistent; the Law on State Compensation Liability with its very strict provisions on responsibility is a big challenge for the prosecuting agencies, especially the responsibility of the People's Procuracy.

 

Implementing the Criminal Procedure Code, the tasks of the Procuracy have increased significantly, throughout the process of receiving and handling denunciations and reports of crimes; in particular, implementing the regulation that Procurators must participate in a number of investigative activities and directly investigate is facing many difficulties, especially for units with large areas and not yet having the conditions to arrange enough civil servants and prosecutors.

 

In the appraisal and valuation work, there is still a phenomenon of shifting responsibility to the presiding agency; slow request for relevant agencies to provide missing documents and information; in some cases, there are signs of fear of responsibility, avoidance, and refusal of appraisal and valuation; appraisal conclusions are still general and do not clearly express viewpoints.

 

The number of civil servants with judicial titles and prosecutors at all levels of the People's Procuracy has not met the requirements of the increased workload; the current budget allocation is not enough to ensure the implementation of the sector's tasks according to the new provisions of the law, especially the task of fighting injustice and wrongdoing; the regime and policies for the sector's civil servants still have many limitations and are not commensurate with the specific tasks that the sector must perform.

 

Regarding solutions for implementation in the coming time, the Chief Justice of the Supreme People's Procuracy emphasized that it is necessary to perform well the task of fighting injustice, mistakes and missed crimes; focus on strengthening the responsibility of prosecution in investigation activities according to the Criminal Procedure Code, achieve and exceed professional targets, especially targets according to the requirements of Resolution No. 96 of the National Assembly, strive to prevent cases of suspension of defendants due to not committing a crime, and the Court declaring the defendant not guilty.

 

The industry focuses on resolving well the cases monitored and directed by the Central Steering Committee on Anti-Corruption and Negativity; promptly and strictly handling serious and complicated criminal cases that attract public attention.
