These are specific and special standards issued by the Politburo to select personnel to hold leading positions in judicial agencies. This content is clearly stated in Regulation No. 365 on standards for positions of cadres under the management of the Party Central Committee, Politburo, Secretariat and the framework of standards for positions of leaders and managers at all levels, recently issued by the Politburo.
Compared with Regulation 214 of 2020, this regulation of the Politburo is much more specific.
In addition to the six general standards on politics, ideology; moral qualities, lifestyle and sense of organization and discipline; qualifications, capacity; prestige and ability to gather and unite; work results; health, age and experience, leaders of judicial agencies must meet specific, specific standards.

Regarding the Chief Justice of the Supreme People's Court , the Politburo stipulates that in addition to fully ensuring the general standards of a Politburo member, Secretariat member or Central Committee member, there must be other standards.
The person holding this position must have high qualifications and a deep understanding of the Vietnamese legal system, international law and practices; and meet the qualifications for the position of Supreme People's Court Judge.
The Chief Justice also needs to have a strategic vision on judicial reform, and be able to orient the organization and operation of the court system according to the requirements of building a socialist rule-of-law state and international integration.
This position must have the capacity to concretize and effectively organize the implementation of the Party's guidelines, policies, and the State's laws in the assigned field; and have the capacity to develop laws .
According to the Politburo, the Chief Justice needs to directly direct the development and completion of the legal system on the organization and operation of the People's Court; be able to organize and implement the summary of trial practices, ensure the unified application of the law, and provide strategic guidance on trials for the entire system.
In addition to the requirement of having experience in leading and directing the activities of judicial agencies; being impartial and objective in directing the trial work, according to the new regulations of the Politburo, the Chief Justice must be the person who has presided over or directed the resolution of many particularly serious and complicated cases; be able to handle multi-dimensional legal situations, ensuring timeliness, accuracy, and compliance with the law. This person must also be a highly prestigious person in the legal profession and the judicial system.
These contents have been supplemented and are more specific than Regulation 214 of 2020.
Also according to the new regulations of the Politburo, the Chief Justice needs to have the capacity to organize the People's Court system at all levels to operate professionally, honestly, and modernly; direct the digital transformation work of the industry, innovate working methods, apply information technology in trial activities, and reform judicial procedures towards openness and transparency.
The Politburo stipulates that the Chief Justice of the Supreme People's Court must have experienced and successfully completed his/her duties in key leadership and management positions at the provincial level or in leadership positions of central ministries, branches and sectors; and must also be an official member of the Central Committee for at least one full term.
Special cases will be decided by the Central Government.
As for the Chief Prosecutor of the Supreme People's Procuracy , in addition to fully meeting the general standards of a Central Committee member, he must be highly qualified and have a deep understanding of the Vietnamese legal system, international law and practices; and be qualified for the position of prosecutor of the Supreme People's Procuracy.
This position also requires standards of strategic thinking, capacity to plan legal institutions on organization and operation of the People's Procuracy; and ability to propose innovative directions for procuracy work in the new situation.
According to the Politburo, the Chief Justice of the Supreme People's Procuracy must be able to direct the drafting and submission of draft laws and ordinances in accordance with the provisions of law; preside over and coordinate with relevant agencies and organizations in the work of drafting laws and promulgating legal documents under his/her authority.
The position of Chief Justice of the Supreme People's Procuracy must also have the capacity to concretize and effectively organize the implementation of the Party's guidelines, policies, and the State's laws in the assigned field; direct the entire sector to develop and deploy action programs to implement the Central Committee's resolutions on judicial reform and building a socialist rule-of-law state; and have the ability to coordinate and connect with agencies in the political system to perform assigned functions and tasks.
In particular, according to the Politburo, the Chief Justice of the Supreme People's Procuracy must be a person with extensive experience in leading and directing the activities of judicial and prosecution agencies; and must have directly directed the handling of major, especially serious cases and incidents, in accordance with the law, without injustice or letting criminals escape.
They also need to have the capacity to organize a system of prosecutors at all levels to operate synchronously, uniformly, with discipline, integrity, and professionalism; to be impartial and objective in directing the implementation of the right to prosecute and supervise justice; to be exemplary in implementing the right to prosecute and supervise justice; and to resolutely fight corruption and negativity in judicial activities.
These are new standards set by the Politburo, which are much more specific than the old regulations issued in 2020.
In addition, the Politburo stipulates that the Chief Justice of the Supreme People's Procuracy must be a member of the Central Committee, have experienced and successfully completed tasks in key leadership and management positions at the provincial level or as leaders of central departments, ministries and branches.
Special cases are decided by the Central Executive Committee of the Party.
