On December 7, 2023, the Government issued Decree No. 86/2023/ND-CP stipulating the framework of standards and procedures, procedures, and dossiers for considering and awarding the titles of "Cultural Family", "Cultural Village, Residential Group", "Typical Commune, Ward, and Town" (Decree No. 86/2023/ND-CP) replacing Decree No. 122/2018/ND-CP dated September 17, 2018 of the Government stipulating the consideration and awarding of the titles of "Cultural Family", "Cultural Village", "Cultural Village", "Cultural Hamlet", "Cultural Village", "Cultural Residential Group" (Decree No. 122/2018/ND-CP).
It can be said that the promulgation of Decree No. 122/2018/ND-CP has contributed to the effective implementation of the Movement "All people unite to build a cultural life", many contents of the Movement have been put into order, the quality has been improved, contributing to the practical completion of socio -economic development tasks and strengthening the great national unity bloc. However, after 5 years of implementation, Decree No. 122/2018/ND-CP has revealed some shortcomings, some contents are no longer suitable for current practice. Decree No. 86/2023/ND-CP was issued to replace Decree No. 122/2018/ND-CP with many new contents, ensuring the consistency and synchronization of the legal system, meeting the requirements of innovation in emulation, commendation and administrative procedure reform, while overcoming current practical difficulties and obstacles, specifically as follows:
1. Amend the regulations on the framework of emulation title standards in a more general and quantitative manner. Supplement the regulations on the responsibilities of the Provincial People's Committee to specify the standards and the awarding of cultural titles based on the framework of standards prescribed by the Government to suit local realities, contributing to the effective awarding of titles, bringing about good public opinion.
2. Supplementing the standard framework for the title "Outstanding commune, ward, town" to encourage and motivate individuals, households, villages, residential groups, communes, and wards to enthusiastically compete and strive to fulfill their tasks well, thereby creating a driving force for local economic development.
3. Amend regulations on review time, documents, procedures, and procedures for awarding cultural titles in a simple, clear, and convenient manner during implementation. Supplement regulations on awarding the title of "Outstanding Commune, Ward, and Town"; reduce many forms compared to Decree No. 122/2018/ND-CP.
Simplifying administrative procedures has helped reduce time and costs (photocopying, printing) for the subjects and agencies handling administrative procedures; people carry out commendation procedures more simply and quickly. In addition, the dossiers for considering and awarding cultural titles are carried out according to internal administrative procedures, not having to be uploaded to the "One-stop - One-stop" system.
4. Decree No. 86/2023/ND-CP stipulates that the awarding of cultural titles is carried out in accordance with the Law on Emulation and Commendation, abolishing the regulations on the rate of awarding Certificates of Merit for "Cultural Family" and "Cultural Residential Area". This ensures compliance with the principle of "Rewarding according to achievements" stipulated in the Law on Emulation and Commendation.
For Phu Tho province, immediately after Decree No. 86/2023/ND-CP was issued, the Provincial People's Committee assigned the Department of Culture, Sports and Tourism to preside over and coordinate with relevant agencies and units to advise the Provincial People's Committee to issue Decision No. 22/2024/QD-UB dated September 19, 2024 detailing the consideration and awarding of the titles "Cultural Family", "Cultural Residential Area", "Typical Commune, Ward, Town" in Phu Tho province (Decision No. 22/2024/QD-UB). Decision No. 22/2024/QD-UB has detailed a number of contents on the method of evaluating and awarding titles, specifically as follows:
1. Detailed criteria for awarding cultural titles are built on the basis of the Framework of standards prescribed in Decree No. 86/2023/ND-CP, inheriting the regulations that are still suitable for reality in Decree No. 122/2018/ND-CP; at the same time, it is suitable for the criteria for recognition of meeting civilized urban standards; criteria for meeting new rural standards in the period of 2021-2025 and the actual situation in the process of implementing the Movement "All people unite to build a cultural life" in the province.
The criteria for evaluating the titles of “Cultural Family” and “Cultural Residential Area” are evaluated on a scale to ensure that people and localities can easily quantify the criteria, as a basis for evaluating emulation titles. The criteria for evaluating the title of “Typical Commune, Ward, Town” require excellence, leading the emulation movement, setting an example for communes, wards, and towns in the province to learn from, so the scale is not applied but the level of “Achieved”.
2. On the conditions for awarding cultural titles
The awarding of the titles of "Cultural Family" and "Cultural Residential Area" under Decree No. 122/2018/ND-CP previously ensured that people and localities could easily quantify the criteria. However, in the process of implementing Decree No. 122/2018/ND-CP, there were still some limitations: The threshold for scoring cultural standards was still low, leading to the subjects achieving cultural titles not being substantial; many households and residential areas still violated acts such as: littering, not complying with village covenants and residential area conventions; village roads and alleys were not clean; encroachment on roads and sidewalks; not implementing civilized lifestyles in weddings, funerals, festivals, etc., but when points were deducted for violations, the total score still reached the threshold for considering cultural titles; leading to the quality of the titles not being guaranteed, not promoting the emulation movement.
The assessment of cultural criteria in Decision No. 22/2024/QD-UB of Phu Tho province is built on the basis of inheriting the advantages and overcoming the limitations in Decree No. 122/2018/ND-CP. Phu Tho province still uses the method of assessing the titles of "Cultural Family" and "Cultural Residential Area" by a scale, but focuses on criteria of awareness, self-awareness, and civilized lifestyle of the people with high scores. The number of points achieved is higher than the implementation of Decree No. 122/2018/ND-CP to improve the quality of cultural titles.
The decision stipulates the number of points achieved for the titles of “Cultural Family” and “Cultural Residential Area”, including the division for areas of particularly difficult communes to ensure fairness between regions in the province. At the same time, it stipulates the proportion of members attending the meeting to evaluate cultural titles and the proportion of people agreeing to recognize cultural titles to increase the autonomy of the residential community; the achievement of titles is evaluated and recognized by the residential community.
3. About rewards and funding
In the period 2018 - 2023, the consideration and awarding of cultural titles will be carried out according to Decree No. 122/2018/ND. In addition to the awarding of cultural titles stipulated in the Law on Emulation and Commendation, Decree No. 122/2018/ND-CP stipulates the rate of awarding certificates of merit for cultural titles. Currently, Decree No. 86/2023/ND-CP of the Government has abolished the consideration and awarding rate of certificates of merit for cultural titles to ensure consistency with the Law on Emulation and Commendation dated June 15, 2022.
In Decision No. 22/2024/QD-UB, the Provincial People's Committee assigned the People's Committees of districts, cities and towns to allocate funds to ensure the good implementation of the work of awarding cultural titles according to regulations. The correct implementation of regulations on the level of rewards attached to the titles will have a very positive impact on improving the quality of emulation movements, promoting the development of grassroots cultural activities, and building a strong cultural environment.
The process of developing and promulgating Decision No. 22/2024/QD-UB was carried out in accordance with the provisions of the Law on Promulgation of Legal Documents; the Law on Emulation and Commendation and the provisions of Decree No. 86/2023/ND-CP. Currently, localities in the province have organized training and guidance on the implementation of the consideration and awarding of cultural titles according to Decree No. 86/2023/ND-CP and Decision No. 22/2024/QD-UB.
In order for the work of awarding cultural titles to achieve good results, it is recommended that all levels, sectors and People's Committees of districts, cities and towns actively propagate and launch emulation movements for communes, wards and towns and all people to actively study and implement well the criteria for evaluating cultural titles; People's Committees of districts, cities and towns pay special attention to arranging and ensuring funding for the implementation of Decision No. 22/2024/QD-UB and awarding cultural titles according to their authority./.
Thanh Thuy District People's Committee organized a training conference to implement Decree No. 86/2023/ND-CP and Decision No. 22/2024/QD-UB for 15 communes, towns and 126 residential areas in the district.
