The head of the expert group evaluating the bid package related to Son Hai Group has expired his practice certificate?

In an official petition sent to the Binh Phuoc Provincial People's Committee on the afternoon of May 27, Son Hai Group requested the province to review the fact that the head of the bid evaluation team had expired his practice certificate. The company also requested to establish an independent expert team to re-evaluate the bid package.

Talking to Tuoi Tre Online about the above reflection of Son Hai Group, a source from Binh Phuoc Provincial People's Committee said that they had received the petition of the contractor on the afternoon of May 27 and would direct the implementation in accordance with regulations.

The head of the bid evaluation team has expired practice certificate?

According to the petition that Son Hai Group officially sent to the People's Committee of Binh Phuoc province requesting to review the bidding process for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway through Binh Phuoc province, the representative of Son Hai Group's leadership raised a question.

Specifically, according to this group, the head of the bid evaluation team of this bid package is Mr. Vu Ngoc Tru. However, the image searched on the Ministry of Finance's system for managing professional certificates on bidding, in the list of individuals granted professional certificates on bidding from January 1, 2025 to January 1, 2030, Mr. Tru's name is not included.

Information about Mr. Tru is in the list of individuals granted practice certificates. However, the data displayed in this section shows that Mr. Tru's practice certificate for bidding is only valid from October 18, 2018 to October 18, 2023. That is, it has expired for more than a year and a half.

According to Son Hai Group, if according to the information on the official website of the Bidding Management Department under the Ministry of Finance, the head of the bid evaluation expert team did not meet the provisions of the bidding law. This is something that the People's Committee of Binh Phuoc province needs to review to ensure fairness, objectivity and legality for the bidding process.

"The investor is showing signs of using an E-HSDT evaluation consulting unit with personnel who do not meet legal regulations to evaluate E-HSDT, which is against the regulations. Therefore, it is necessary to review the accuracy and reasonableness of the E-HSDT evaluation results in the evaluation reports of the expert team," said the leader of Son Hai Group.

Son Hai Group also recommended that the People's Committee of Binh Phuoc province check and review the capacity of the members of the E-HSDT assessment expert team.

"We propose to establish an independent interdisciplinary expert team with the investor and the bidding party to re-evaluate the E-HSDT for the above bidding package, ensuring that the bidding process's goals are competitive, fair, transparent and economically efficient," the leader of Son Hai Group continued.

As reported by Tuoi Tre Online , Son Hai Group has responded to the results of the contractor selection for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway, through Binh Phuoc province.

Of these, 4 contractors were rejected: Cienco4 Group Joint Stock Company and Son Hai Group LLC participated as independent contractors; joint venture contractors included Binh Phuoc Expressway Joint Venture (Dai Phong Infrastructure Construction Joint Stock Company - Vinaconex - Lu Gia Mechanical and Electrical Joint Stock Company) and IB250005761 Expressway Joint Venture (Hai Dang - Deo Ca - Thuan Ha Joint Stock Company).

All four contractors were rejected for the same reason: they did not pass the technical evaluation.

The winning bidder is the HCM-TDM-CT Joint Venture (Truong Son Construction Corporation and NTV Thanh Phat Construction, Service and Trading Company Limited).

The bid package is worth over VND880 billion. Of which, Son Hai Group bid the lowest price of just over VND732 billion, saving the State VND148 billion and doubling the warranty period - from the required 5 years to 10 years.

The winning bidder offered the highest bid of over VND866 billion, just over VND14 billion lower than the investor's offer.

Previously, on May 6, a team of experts (established by the consulting unit) prepared a report evaluating the electronic bidding documents (E-HSDT) and sent it to the Binh Phuoc Provincial Construction Investment Project Management Board (project investor).

Explaining the reason why the contractor did not meet the technical requirements stated in the E-HSDT of Son Hai Group, the expert team assessed that the contractor did not meet the requirements for materials and equipment provided for the bid package; did not meet the requirements for organizing the implementation of the building information model (BIM) in the bid package; did not meet the requirements for construction machinery and equipment serving the construction of the bid package.

Based on the E-HSDT assessment, the expert team agreed and recommended that the investor consider selecting the HCM-TDM-CT Expressway Joint Venture.
