Saigon Real Estate Corporation is not allowed to continue the project of building a cluster of 15 apartments in Thanh Da.

Ho Chi Minh City Department of Construction said that there is no basis to consider the proposal of Saigon Real Estate Corporation Limited (RESCO) to continue the project of building a cluster of 15 apartment buildings in Thanh Da.

The Ho Chi Minh City Department of Construction has just sent a document to the Ho Chi Minh City People's Committee regarding the request of Saigon Real Estate Corporation Limited (RESCO) to continue implementing the investment project to build a cluster of 15 apartment buildings in Thanh Da residential area (Binh Thanh district).

According to the authorities, since 2010, the City People's Committee has issued Official Letter No. 3294/UBND-DTMT approving the policy for RESCO to invest in rebuilding the Thanh Da apartment complex and to "Complete the project investment plan". However, after 6 years, RESCO has not yet completed the project. The enterprise has only conducted measurements and surveys of the current status of the project implementation area and proposed adjustments to some planning indicators at a scale of 1/2,000, and organized a competition for detailed planning design plans at a scale of 1/500.

In 2016, the People's Committee of Binh Thanh District organized a quality inspection of all 15 apartment buildings in Thanh Da Residence. According to the results of the construction quality inspection conducted by the Center for Housing Management and Construction Inspection and Saigon Construction Inspection Joint Stock Company, the apartment complex in Thanh Da Residence has a danger level of "class C house" - not seriously damaged or dangerous enough to require urgent demolition.

Cluster of 15 apartments in Thanh Da residential area continues to be "suspended"

In January 2017, the Ho Chi Minh City People's Committee continued to issue a document assigning RESCO within 6 months to complete the research and proposal for the project to be implemented, and to establish a detailed planning scheme of 1/500... After 6 months, it is considered that the investment will not continue and all costs incurred will be borne by RESCO. However, after 18 months, RESCO only has a proposal.

On the other hand, the project has not been approved in principle for investment, the investor has not been approved or the investor has not been recognized according to the provisions of the law on housing investment, so there is no legal basis to consider handling the project's transition according to the provisions of the 2014 Investment Law.

Based on the actual implementation of the enterprise, legal regulations and opinions of the Department of Planning and Investment, the Department of Justice, and the Department of Construction of Ho Chi Minh City, there is no legal basis to consider the content of RESCO's proposal to continue implementing the Thanh Da apartment complex investment project. The enterprise must bear all costs for the work performed according to the tasks previously assigned by the City People's Committee.

The Department of Construction also proposed that the Ho Chi Minh City People's Committee assign the Binh Thanh District People's Committee to organize a review, inspection, and quality assessment of all 15 Thanh Da apartment buildings and issue inspection conclusions, publicly post them on the electronic information portal of the Binh Thanh District People's Committee and send them to the Department of Construction for public disclosure on the electronic information portal.

The disclosure of the above information is the basis for implementing the next steps of the regulations on selecting investors and implementing projects according to the Housing Law 2023 and current guiding documents.
