
The Department of Construction of Ho Chi Minh City has just issued Document No. 10582/SXD-QLN&TTBDS on solutions for management and use of housing funds and residential land belonging to public assets for resettlement (TDC) for public investment projects (DAĐTC) in the city after the 2-level local government model is applied.
According to the Department of Construction, the demand for resettlement and temporary housing for urban resettlement projects in the city is currently very large. In addition to 253 projects that have been allocated to use apartment funds and land for resettlement according to issued decisions, in the near future, it is expected that there will be a need for about 2,215 more apartments and plots. Specifically: National Highway 13 Project (220 apartments and plots), National Highway 1 Expansion (539 apartments and plots), Binh Tien Bridge (159 apartments and plots), National Highway 22 (457 apartments and plots), Van Thanh Canal (749 apartments and plots), D3 Road (39 apartments and plots), Can Giuoc River embankment (52 apartments and plots)...
The Department of Construction said that in reality, the arrangement of housing and land for resettlement still has many limitations such as: A part of the housing and land fund for resettlement has not been put into use in a timely manner; the arrangement of resettlement is not synchronous between regions, leading to surplus in some places and shortage in others; the mechanism for exploiting and handling housing and land funds is not flexible, and there are still legal and procedural problems.

To solve the above problem, the Department of Construction proposed short-term solutions: In the compensation, support and resettlement plan, only the number of households and individuals eligible for resettlement and resettlement locations are stated, but the number of apartments and land plots required for resettlement is not stated. At the same time, it is stipulated that in addition to the resettlement plan with apartments and land plots, it is possible to choose the option of receiving support in cash (compensation at market price), ordering to buy commercial housing (NOTM), and giving priority to approving the purchase of social housing (NOXH) to serve resettlement.
In the immediate future, the Department of Construction will advise the City People's Committee on individual allocation decisions for each newly arising project through the adjustment and supplementation of Decision No. 2954/QD-UBND dated July 31, 2024. The main purpose is to promptly meet the source of housing and residential land for urgent resettlement projects, by allocating no more than 40% of apartments and land compared to the registered local demand. The remaining apartments and resettlement land will be used for new public investment projects. At the same time, a portion of the apartments will be allocated to the housing fund for resettlement for common use by resettlement projects when the private apartments have been used up.
In the long term, the Department of Construction proposes to promote the development of land for resettlement and social housing in the direction that the People's Committees of wards and communes must be responsible for developing, investing in construction, and creating residential land for resettlement in the area to ensure that residential land for resettlement meets local needs in the coming time. Prioritize land funds suitable for planning in the commune, to invest in building resettlement areas or social housing projects for resettlement in accordance with the provisions of the Law on Real Estate Business, the Law on Public Investment, the Law on Land and other relevant legal provisions.
The Department of Construction also recommended focusing on developing social housing to serve low-income people and affected households and individuals in urban development projects in the area; reviewing and arranging land funds within the scope of investment projects to build urban housing or using budget funds collected from urban development projects. Urban areas are obliged to regulate 20% of land funds for social housing in the form of cash payments to develop social housing.
The Department of Construction will advise the City People's Committee to authorize the agencies and units responsible for compensation, support, and resettlement to use the entire apartment fund and land for resettlement in the city. This is done according to the principle of time priority when people choose and the competent authority issues a decision on resettlement arrangement.
