Ho Chi Minh City supports rental costs of 24 million VND/month for houses and land that have been recovered

The subjects of application are state agencies exercising the powers and responsibilities of representing the entire people's ownership of land, performing the task of unified state management of land and civil servants performing land administration work at the commune level; units and organizations performing the tasks of compensation, support and resettlement; people whose land is recovered and owners of assets attached to recovered land; other subjects related to compensation, support and resettlement when the State recovers land.

Ho Chi Minh City supports rental costs up to 24 million VND/month for households whose houses and land are recovered.

According to the content of the Decision, in case households and individuals are using land specified in Clause 2, Article 19 of Decree No. 88/2024/ND-CP, they will be supported with VND 1,000,000/person/month, for a period of 3 months if they do not have to move their residence and for a period of 6 months if they have to move their residence; in case they have to move to areas with difficult socio-economic conditions or with especially difficult socio-economic conditions, the support period is 12 months.

Support for dismantling, demolishing, and relocating for owners of houses and constructions built under a limited-term construction permit, but by the time of land recovery, the permit has expired.

For properties attached to land that are houses and construction works under construction permits with a term according to the law on construction, but by the time of land reclamation the permit has expired, the property owner shall not be compensated according to the provisions of Clause 3, Article 105 of the Land Law but shall be supported for dismantling, demolishing, and relocating with a support level equal to 80% of the new construction value of the house or construction work with equivalent technical standards according to the provisions of the law on construction.

Notably, the level of support for temporary housing rental costs is for households and individuals who are permanent or temporary residents at the location of the house being cleared before the time of land recovery notice, as follows:

Area 1 (districts: 1, 3, 4, 5, 6, 7, 8, 10, 11, 12, Go Vap, Binh Thanh, Phu Nhuan, Tan Binh, Tan Phu, Binh Tan and Thu Duc City) for households with 4 or less people, the support level is 8,000,000 VND/household/month; for households with 5 or more people, the support level is 2,000,000 VND/person/month, but the total support level does not exceed 24,000,000 VND/household/month.

Area 2 (towns, districts and areas that have implemented new urban construction projects according to the urban and rural system planning in Binh Chanh, Hoc Mon, Cu Chi, Nha Be, Can Gio districts) for households with 4 or less people, the support level is 7,000,000 VND/household/month; for households with 5 or more people, the support level is 1,750,000 VND/person/month, but the total support level does not exceed 21,000,000 VND/household/month.

Area 3 (communes of Binh Chanh, Hoc Mon, Cu Chi, Nha Be, Can Gio districts) for households with 4 or less people, the support level is 6,000,000 VND/household/month; for households with 5 or more people, the support level is 1,500,000 VND/person/month, but the total support level does not exceed 18,000,000 VND/household/month.

In case the entire house and land of the household is confiscated, they will be rewarded 15 million VND if they relocate before the deadline. Organizations whose factories or offices are confiscated will be rewarded 10,000 VND/m2 with a maximum of 200 million VND and a minimum of 15 million VND.
