HCMC: Reviewing the entire staff, civil servants and public employees to arrange and assign suitable jobs

The People's Committee of Ho Chi Minh City has just issued a document conveying the direction of Chairman of the People's Committee of Ho Chi Minh City Nguyen Van Duoc on recruitment; appointment of leadership and management positions; promotion of civil servant ranks, promotion of professional titles of public employees and labor contracts according to Decree No. 111/2022/ND-CP, when implementing the organization and apparatus arrangement of the political system of Ho Chi Minh City.

The Chairman of the Ho Chi Minh City People's Committee directed agencies, units and localities to focus on reviewing the entire staff, civil servants and public employees (collectively referred to as cadres) to arrange and assign them to positions suitable to their qualifications, abilities and requirements for performing tasks. There must not be a shortage of staff while agencies and units still have surplus cadres, civil servants and public employees.

Priority is given to those who are healthy, have good qualities and ethics; have professional qualifications, good working capacity, have many achievements in work, have many contributions to the collective and the results of the common tasks of the agency or unit. Consider and remove from the apparatus those who are no longer in good health, have limited capacity, have reduced prestige, and cannot meet the requirements of the task.

Agencies, units and localities shall develop plans to arrange and use appropriate personnel, ensuring the implementation of the goal of "reducing at least 20% of civil servants and public employees receiving salaries from the state budget to reduce staffing" and "the number of leaders, managers and the number of cadres, civil servants, public employees and workers in agencies, organizations and units in the political system after rearrangement in accordance with regulations" within 5 years from the date the decision on rearrangement of the organization and apparatus of the competent authority takes effect.

The Chairman of the Ho Chi Minh City People's Committee requested to strictly suspend the organization of civil servant recruitment exams until there is specific direction from the competent authority. At the same time, temporarily suspend the implementation of accepting civil servants (for cases that are not civil servants), including cases where agencies, units, and localities are implementing the process but have not yet issued a decision. Only consider and implement the procedures for accepting civil servants for cases under the management of the Standing Committee of the City Party Committee that the competent authority at the city level has notified and given specific instructions.

Ho Chi Minh City also temporarily suspends the recruitment of civil servants (including civil servant examination and admission) at public service units whose regular expenditures are guaranteed by the State, public service units that partially self-guarantee regular expenditures, and public service units that are implementing the arrangement and organization of their apparatus according to regulations; including cases where agencies, units, and localities are implementing the process but have not yet issued a decision.

The Chairman of the Ho Chi Minh City People's Committee requested strict implementation of the policy of temporarily suspending planning, mobilizing, rotating, appointing, perfecting, supplementing, and introducing candidates for leadership and management positions at all levels according to Conclusion No. 128-KL/TW; including cases where the appointment process is being carried out but no decision has been issued.

The Chairman of the Ho Chi Minh City People's Committee also directed the signing of labor contracts according to Decree No. 111/2022/ND-CP when implementing the organization and apparatus arrangement of the city's political system. Accordingly, the signing of new labor contracts according to Decree No. 111/2022/ND-CP is temporarily suspended to review, arrange, and allocate surplus human resources when implementing the arrangement and streamlining of the organization and apparatus and administrative units at all levels for signing contracts to perform support and service work.

Agencies and units shall review and evaluate the need to use contract labor for support work in accordance with the requirements of organization and apparatus arrangement and streamlining, ensuring effective management and use of public assets and preventing and combating corruption and waste in the use of the State budget. Based on the actual situation, the head of the agency or unit shall decide on the arrangement and continued signing of labor contracts for cases currently working or receiving from other agencies or units (if any) and shall be responsible for the signing according to regulations.

For contracts for professional and technical work, agencies and units must strictly implement the direction of the Ho Chi Minh City People's Committee on recruiting civil servants and signing contracts for professional and technical work as stated in Section 1 of Official Dispatch No. 5178/UBND-VX dated September 5, 2024 on strengthening the review and implementation of legal regulations on civil servant recruitment.

The Chairman of the Ho Chi Minh City People's Committee requested agencies, units, and localities to regularly disseminate and deploy to agencies, units, and all cadres, civil servants, public employees, and workers under their management authority to strictly implement the direction of the Politburo in Conclusion No. 126-KL/TW, Conclusion No. 127-KL/TW, Conclusion No. 128-KL/TW and of the Standing Committee of the Ho Chi Minh City Party Committee. Strictly implement the policy of temporarily suspending recruitment, appointment, planning, mobilization, job transfer, reception, and rotation of cadres, civil servants, and public employees according to Conclusion No. 128-KL/TW.
