Forestry land dispute, siblings take each other to court

Tuy An District People's Court has just tried a land use rights dispute between Mr. PVN and his younger brother PVT, both residing in An Hiep commune (Tuy An district).

According to the trial, in 1996, Mr. N's household was assigned 2,260 square meters of forestry land in My Phu 1 village (An Nghiep commune) by the Tuy An district People's Committee. In 1999, Mr. N temporarily assigned the land to his biological father for cultivation. After his biological father passed away (in 2012), Mr. T continued to use this land and grow perennial trees.

Mr. N filed a lawsuit, demanding that Mr. T return all 2,260 square meters of land and assets on the land. Mr. T claimed that his father had given it to him, but there was no documentation to prove it.

Based on the records, evidence and testimony in court, the panel of judges accepted the lawsuit request, forcing Mr. T to return the land he was managing to Mr. N and his wife.
