Submit to the National Assembly a draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution

Presenting the report, Vice Chairman of the National Assembly Nguyen Khac Dinh, Vice Chairman of the National Assembly's Draft Resolution on amending and supplementing a number of articles of the 2013 Constitution, emphasized: The Committee determined that amending and supplementing a number of articles of the 2013 Constitution must ensure the absolute, comprehensive and direct leadership of the Party; comply with the Political Platform, the Party Statutes, the principles and regulations of the Party Central Committee, the Politburo, and the Secretariat; and must be based on the results of reviewing and evaluating the practical implementation of specific provisions of the 2013 Constitution and related laws, especially laws on the organization of the state apparatus. The amendment and supplementation of the Constitution must be conducted carefully, objectively, democratically, scientifically, effectively, and in full compliance with the procedures prescribed by law.

Based on the scope of amendments and supplements to the Constitution decided by the National Assembly in Resolution No. 194/2025/QH15, the Committee determined that the draft Resolution amending and supplementing a number of articles of the 2013 Constitution consists of 2 articles: Article 1 includes 8 clauses amending and supplementing a number of provisions of the 2013 Constitution on the Vietnam Fatherland Front and socio-political organizations, on administrative units and local government organizations; Article 2 includes 3 clauses regulating the effective date and transitional provisions. Specifically:

Amending and supplementing regulations on position, functions, organizational principles and operations of the Vietnam Fatherland Front

Regarding the Vietnam Fatherland Front and socio-political organizations (in Articles 9 and 84 of the 2013 Constitution), Vice Chairman of the National Assembly Nguyen Khac Dinh stated: To clarify the core role of the Vietnam Fatherland Front, emphasize its position as the central organization of the great national unity bloc, ensure the legal basis for the arrangement of the organizational apparatus of the Vietnam Fatherland Front and socio-political organizations, it is proposed to amend and supplement the regulations on the position, functions, principles of organization and operation of the Vietnam Fatherland Front in Article 9 to ensure conformity with the new organizational model after the arrangement of socio-political organizations under the Vietnam Fatherland Front. At the same time, it is stipulated that the Central Committee of the Vietnam Fatherland Front has the right to submit draft laws and draft ordinances in Clause 1, Article 84 of the 2013 Constitution to be consistent with the content of the amendment and supplement to Article 9 mentioned above.

Additional duties of Vietnam Trade Union

Regarding the Vietnam Trade Union (in Article 10 of the 2013 Constitution), on the basis of reasonable inheritance of the current provisions of the Constitution on the position and role of the Trade Union organization and ensuring consistency with the proposed amendments and supplements in Article 9 of the 2013 Constitution, the Committee proposes to amend and supplement Article 10 in the direction of affirming that the Vietnam Trade Union is a socio-political organization of the working class and laborers, directly under the Vietnam Fatherland Front, and at the same time, supplementing the task of the Vietnam Trade Union as the representative of laborers at the national level in labor relations and international relations on trade unions to suit the context of international economic integration.

Regarding the organization of administrative units and some other contents on local government (in Chapter IX of the 2013 Constitution, implementing the Party's policy on streamlining the apparatus of the political system, organizing two-level local government and ending the operation of district-level administrative units, the Committee proposes to only provide general regulations on the delimitation of administrative units of the Socialist Republic of Vietnam in Article 110 including provinces, centrally run cities and administrative units below provinces, centrally run cities, special administrative-economic units established by the National Assembly. The determination of types of administrative units below provinces and centrally run cities and the order and procedures for establishing, dissolving, merging, dividing administrative units, and adjusting administrative unit boundaries are prescribed by the National Assembly.

At the same time, institutionalize the conclusions of the Central Committee, the Politburo, and the Secretariat on the organization of local governments at the provincial and communal levels with People's Councils and People's Committees, propose to amend and supplement Articles 111, 112, and 114 in the direction of regulating the organization of local governments including People's Councils and People's Committees, not using the term "local government level"; not regulating the Chief Justice of the People's Court and the Chief Prosecutor of the People's Procuracy within the scope of subjects answering questions of People's Council delegates in Clause 2, Article 115 to be consistent with the nature and organizational model of local state agencies after the implementation of the arrangement.

Submit to the National Assembly for consideration and approval at the meeting on June 24, 2025

Vice Chairman of the National Assembly Nguyen Khac Dinh said that the Committee proposed to determine the effective date of the Resolution as July 1, 2025.

In order to promptly institutionalize the conclusions and directions of the Central Committee, the Politburo, the Secretariat, and the Committee, it is recommended that the draft Resolution include an official provision declaring the end of the operation of district-level administrative units and a transitional provision regulating the appointment of positions of the People's Council, People's Committee, and Head and Deputy Head of the National Assembly Delegation when arranging provincial and commune-level administrative units in 2025 and perfecting the organizational structure of the People's Council and People's Committee for the 2021-2026 term when there are no more district-level administrative units.

The process of collecting opinions from the people, sectors and levels on the draft Resolution has officially started from May 6 and will be completed on June 5, 2025 in a democratic and substantive spirit, in many diverse forms, enhancing the application of information technology, suitable to the reality at the grassroots level, creating favorable conditions for all classes of people to participate in giving opinions.

Based on the comments of the people, sectors, levels and opinions of National Assembly deputies, the Committee and relevant agencies and organizations will study, absorb and complete the draft Resolution to report to the National Assembly for discussion and comments once again, then absorb, revise the draft Resolution and submit it to the National Assembly for consideration and approval at the meeting on June 24, 2025 in accordance with the Session Agenda approved by the National Assembly./.
