Procedure for taking a vote of confidence by secret ballot for 30 key leaders of the People's Council and People's Committee of Nghe An province

At the 16th Session to be held on the afternoon of October 27, 2023, 81 delegates of the 18th Nghe An Provincial People's Council, term 2021 - 2026, will hold a secret ballot to vote for confidence in 30 people holding positions elected by the Provincial People's Council.

The Standing Committee of Nghe An Provincial People's Council issued Plan No. 242/KH-HDND dated September 8, 2023 to organize a vote of confidence. Accordingly:

The process of obtaining a vote of confidence consists of 5 steps:

- The person who is voted for a vote of confidence must send a report (according to the form) and a Declaration of assets and income to the Standing Committee of the Provincial People's Council before September 26, 2023 so that the Standing Committee of the Provincial People's Council can send it to the Provincial People's Council delegates.

- The Provincial Vietnam Fatherland Front Committee shall issue a written notice on the results of synthesizing voters' opinions and recommendations related to the person holding the position elected by the Provincial People's Council (if any) and send it to the Standing Committee of the Provincial People's Council before October 1, 2023 so that the Standing Committee of the Provincial People's Council can send the person to whom the vote of confidence is taken and the Provincial People's Council delegates.

- In case it is necessary to clarify issues related to the person being voted for, no later than October 11, 2023, the Provincial People's Council delegate can send a document to the Standing Committee of the People's Council to request the competent authority to verify and respond in writing.

- Before October 16, 2023, provincial People's Council delegates can send documents to the Standing Committee of the People's Council and the person whose confidence is being voted on to request the person whose confidence is being voted on to clarify the contents of the basis for assessing the level of confidence.

- At least 3 days before the meeting to take the vote of confidence, the person subject to the vote of confidence shall report and explain (according to the form) the issues related to himself/herself mentioned in the summary report of the Provincial Vietnam Fatherland Front Committee and the opinions of the Provincial People's Council delegates (if any), and send them to the Standing Committee of the Provincial People's Council and the Provincial People's Council delegates who have opinions on the person subject to the vote of confidence.

The procedure for taking a vote of confidence at the 16th Session of the 18th Nghe An Provincial People's Council includes 7 steps:

- The Standing Committee of the Provincial People's Council submits to the Provincial People's Council for decision the list of people to be voted on for confidence.

- Provincial People's Council delegates discuss in groups.

- The Standing Committee of the Provincial People's Council reports to the Provincial People's Council the results of the discussion in the Group. The session to take a vote of confidence can only be held when at least two-thirds of the total number of Provincial People's Council delegates attend.

- The Provincial People's Council established a Vote Counting Committee.

- The Provincial People's Council takes a vote of confidence by secret ballot.

- The counting committee reports the vote counting results.

- The Provincial People's Council considers and approves the Resolution confirming the results of the vote of confidence at the request of the Standing Committee of the Provincial People's Council.

The results of the vote of confidence are used to evaluate cadres, as a basis for planning, mobilizing, appointing, recommending candidates, dismissing and implementing regimes and policies for cadres.

A person who is voted on for a vote of confidence and has more than half to less than two-thirds of the total votes for "low confidence" can resign; in case he/she does not resign, the Standing Committee of the Provincial People's Council shall submit to the Provincial People's Council to conduct another vote of confidence at the session or the nearest session of the Provincial People's Council.

If a person subject to a vote of confidence receives a "low confidence" rating from two-thirds of the total votes or more, the agency or person with authority to recommend that person for election or approval by the Provincial People's Council shall be responsible for submitting to the Provincial People's Council for dismissal or approval of the proposal for dismissal at the nearest session or meeting of the Provincial People's Council.

As reported by Nghe An Newspaper, at the regular meeting in September 2023 held on the afternoon of September 29, the Standing Committee of the Provincial People's Council agreed to organize the 16th Session (Special Session) on the afternoon of October 27, 2023, to conduct a vote of confidence for the positions held by the Provincial People's Council, including: Chairman of the People's Council, Vice Chairmen of the People's Council, Head of the People's Council Committee, Chairman of the People's Committee, Vice Chairmen of the People's Committee, members of the Provincial People's Committee elected by the Provincial People's Council before January 1, 2023 (30 people).

In which, the Provincial People's Council bloc (7 people) includes: Chairman of the Provincial People's Council, 2 Vice Chairmen of the Provincial People's Council, Head of the Economic - Budget Committee of the Provincial People's Council, Head of the Legal Committee of the Provincial People's Council, Head of the Cultural - Social Committee of the Provincial People's Council; Head of the Ethnic Committee of the Provincial People's Council.

The Provincial People's Committee (23 people) includes: Chairman of the Provincial People's Committee, 4 Vice Chairmen of the Provincial People's Committee and 18 members of the Provincial People's Committee including: Director of the Provincial Police, Commander of the Provincial Military Command, Chief of the Provincial People's Committee Office, Chief of the Provincial Inspectorate, Head of the Provincial Ethnic Minorities Committee; and Directors of 13 departments: Labor - Invalids and Social Affairs, Information - Communications, Tourism, Construction, Education and Training, Finance, Justice, Home Affairs, Natural Resources and Environment, Transport, Industry and Trade, Culture - Sports, Foreign Affairs.
