The Chinese government has just announced new regulations on export control of civil- military dual-use items, aiming to improve the legal system related to export activities. This is considered an important step in improving China's export control capacity, strengthening the enforcement mechanism of non-proliferation of weapons of mass destruction (WMD) and contributing to global nuclear non-proliferation efforts.
Previously, on October 19, 2024, Chinese Premier Li Qiang signed a decree of the State Council promulgating regulations on export control of dual-use goods, effective from December 1, 2024. The regulations consist of 6 chapters and 50 articles, designed to ensure international peace, combine economic development with national security, and enhance the ability to control the export of goods that can be used for both civilian and military purposes.
Dual-use items include goods, technologies and services that can be used for either civilian or military purposes, especially those that could support the development, production or use of weapons of mass destruction. Strictly controlling the export of these items will help ensure national security and protect China's development and security interests.

Huang Huikang, chairman of the Chinese Foreign Ministry's International Law Advisory Committee, said that strengthening export controls on dual-use items is necessary in the current context, when China is facing many opportunities but also risks and challenges. He stressed that this not only helps protect national interests but is also a step in line with the global trend of export control and nuclear non-proliferation.
Huang also said that the new regulations are an important measure to enhance the law enforcement capability related to exports, help China fulfill its international obligations and promote global non-proliferation cooperation. He affirmed that the application of domestic export control measures to ensure non-proliferation of WMD is a common practice of major countries and is in line with the security exception provisions of the World Trade Organization (WTO).
The highlight of the new regulations is that the export registration system for dual-use goods will be abolished, replaced by increased transparency and standardization in export management. At the same time, the regulations also include detailed management measures on licensing, control lists and strict monitoring of dual-use goods exports.
The new regulations will create a transparent, stable and predictable institutional environment that will improve the efficiency of China's export management, experts said. Mei Xiaying and Fu Jun, professors at the University of International Business and Economics, said the regulations not only balance development and security, but also differ from other countries that use export controls as a political or power tool.
In addition to ensuring national security, China’s new regulations also promote economic development by not hindering normal trade in dual-use goods. China’s Ministry of Justice and Ministry of Commerce stressed that the export control measures are not a ban, but comply with international standards to ensure trade security, promote economic development and protect the global supply chain.
Han Liyu, a professor at the School of Law of Renmin University of China, said the new legal system is built in line with international economic and trade rules, helping to protect China's fundamental security interests and creating a more stable and transparent export environment for businesses.
With these new moves, China not only strengthens its position in controlling the export of dual-use goods but also demonstrates its strong commitment to maintaining global peace and security.
