(Chinhphu.vn) – Amending and supplementing a number of articles of the 2013 Constitution at present is extremely necessary, creating a constitutional basis for implementing the revolution in streamlining the organizational apparatus, building, perfecting, and improving the operational efficiency of the political system, meeting the requirements and tasks of rapid and sustainable national development in the new era.

Vice Chairman of the National Assembly Nguyen Khac Dinh presented a report requesting the National Assembly to consider and decide on amending and supplementing a number of articles of the 2013 Constitution and a report on the establishment of a Committee to draft amendments and supplements to a number of articles of the 2013 Constitution.

At the opening session of the 9th Session this morning (May 5), the National Assembly listened to Vice Chairman of the National Assembly Nguyen Khac Dinh present a Proposal requesting the National Assembly to consider and decide on amending and supplementing a number of articles of the 2013 Constitution and a Proposal on the establishment of a Committee to draft amendments and supplements to a number of articles of the 2013 Constitution.

Referring to the need to amend and supplement a number of articles of the 2013 Constitution, Vice Chairman of the National Assembly Nguyen Khac Dinh said that since the founding of the Democratic Republic of Vietnam - now the Socialist Republic of Vietnam - our country has had 5 Constitutions, marking different stages in the process of building and developing the country.

The 2013 Constitution is the Constitution of the period of comprehensive and synchronous innovation, meeting the requirements of national construction and defense and international integration, in which it specifically stipulates the position, functions, tasks, and relationships of the Vietnam Fatherland Front, socio- political organizations, and the demarcation of local administrative units in our country with the names of each type of administrative unit at 3 levels: provincial level, district level, and commune level.

After more than 11 years of implementation, the provisions of the 2013 Constitution have created an important constitutional basis for perfecting the organization and operation of the political system. The Vietnam Fatherland Front, socio-political organizations, and member organizations of the Front continue to affirm their role in promoting democracy, representing, and protecting the legitimate and legal rights and interests of the People.

The organization and operation of local governments are constantly being innovated and improved, increasingly meeting the requirements of the country's development practices and international integration requirements, enhancing the participation of people and communities in local governance; the operation of the administrative apparatus serves people and businesses better and better, contributing to ensuring synchronization and unity in the organization and operation of the political system from the central to local levels.

In addition to the achievements, the implementation of the provisions of the Constitution and laws related to the Fatherland Front, socio-political organizations and local authorities still has some issues that need to be further improved to meet the practical requirements of national development. Some functions and tasks of the Vietnam Fatherland Front have not been fully promoted, there are still overlaps and interferences in functions and tasks, overlaps in the objects of mobilization and gathering in some member organizations of the Front, at times and in some places, it is not really close to the grassroots, and it is not timely to grasp the situation of the people.

The 3-level local government model has revealed its cumbersome, overlapping, and duplication of tasks and powers, creating many administrative procedures, and has not yet maximized the application of scientific and technological achievements to improve the effectiveness of state management and serve the people and businesses. The existence of many small-scale administrative units has dispersed resources, failed to promote the advantages and potentials of localities for socio-economic development, causing difficulties in planning, rational, economical, and effective use of resources for socio-economic development of the country.

In the above context, our Party has advocated streamlining the organization and apparatus of the political system to ensure the requirements of being lean, compact, strong, and operating effectively, efficiently, and effectively.

Resolution No. 60-NQ/TW of the 11th Conference of the 13th Party Central Committee dated April 12, 2025 agreed on the orientation to build a two-level local government organization model, arrange socio-political organizations, and mass associations assigned by the Party and State into the Vietnam Fatherland Front.

Therefore, amending and supplementing a number of articles of the 2013 Constitution at present is extremely necessary, creating a constitutional basis for implementing the revolution of streamlining the organizational apparatus, building, perfecting and improving the efficiency of the political system, meeting the requirements and tasks of rapid and sustainable national development in the new era - the era of striving for strong, prosperous development of the nation.

Vice Chairman of the National Assembly Nguyen Khac Dinh said that the purpose and requirements of amending and supplementing a number of articles of the 2013 Constitution are to promptly institutionalize the Party's policy on continuing to innovate and reorganize the political system to be streamlined, strong, efficient, and effective; create a constitutional basis for the arrangement of agencies of the Vietnam Fatherland Front, socio-political organizations, and mass organizations assigned by the Party and State, and perfect the model of organizing two-level local governments in the direction of being closer to the people, serving the people better.

Ensuring the Party's comprehensive and absolute leadership; the content of amendments and supplements to the Constitution must be based on the policies and orientations of the Party Central Committee, the Politburo, and the Secretariat and must fully comply with the procedures prescribed by law.

Amendments and supplements to the 2013 Constitution must be based on the results of reviewing and evaluating the practical implementation of specific provisions of the 2013 Constitution and related laws, especially laws on the organization of the state apparatus.

Amending and supplementing the Constitution is an important task that needs to be carried out carefully, objectively, democratically, scientifically and effectively; with a mechanism to ensure the participation of experts, scientists, managers and to collect public opinions; focusing on communication work, ensuring the right direction, not allowing bad elements and hostile forces to take advantage of distorting and sabotage the process of researching, amending and supplementing the Constitution.

Regarding the orientation of the content of amendments and supplements, the Standing Committee of the National Assembly proposed that the National Assembly consider and decide on the amendments and supplements to a number of articles of the 2013 Constitution, focusing on two groups of contents.

Specifically, the regulations related to the Vietnam Fatherland Front and socio-political organizations. The regulations in Chapter IX are to implement the two-level local government organization model; at the same time, there are transitional regulations to ensure that local governments operate smoothly and without interruption, in accordance with the roadmap for implementing the arrangement and merger of provincial and commune-level administrative units, without organizing at the district level.

Because the scope of this amendment and supplement to the Constitution is limited, expected to only involve about 8/120 articles of the 2013 Constitution, it is proposed that the National Assembly determine the form of document to amend and supplement a number of articles of this Constitution as a Resolution of the National Assembly.

Vice Chairman of the National Assembly Nguyen Khac Dinh also reported to the National Assembly on the establishment of the Committee to draft amendments and supplements to a number of articles of the 2013 Constitution. Accordingly, based on the scope of amendments and supplements to a number of articles of the 2013 Constitution, the Standing Committee of the National Assembly plans to have a 15-member Committee to draft amendments and supplements to a number of articles of the 2013 Constitution, chaired by the Chairman of the National Assembly, with representatives of leaders of central agencies and organizations.
