Regarding the issue of people who signed a contract in principle to ensure the right to buy future apartments at the Gem Riverside project (Thu Duc City, Ho Chi Minh City) but were later unilaterally terminated the contract as reported by Tuoi Tre Online , Dat Xanh Group Joint Stock Company has a new response on customer support plans.
Dat Xanh said "no fault"
Currently, Dat Xanh has changed the commercial name of the Gem Riverside project to The Privé and is promoting it to customers with the new name.
According to Dat Xanh, The Privé project has completed important legal procedures, including investment policy approval documents, detailed 1/500 planning and construction permit.
Actual project records show that the construction contractor, Hoa Binh Construction Group, is constructing the basement foundation for the project.
Dat Xanh said that the company will complete procedures and submit documents to competent authorities to confirm that the project is eligible to sell future housing in accordance with legal regulations.
Regarding the principle contracts that customers signed and paid hundreds of millions of dong many years ago, Dat Xanh said that the principle contracts signed since 2019 all stipulate a validity period of 18 months.
After this period, if the apartment purchase contract is not signed and there is no written response from the customer, the contract will "naturally expire".
The company said that the project had not met the legal conditions for sale so it had not signed a contract in order to "comply with the law, not the investor's fault". At the same time, the company had sent out multiple notices of invitation to work and notices of contract termination.
Two options for "negotiating" with customers
Regarding the solution for customers when unilaterally terminating the contract, this time Dat Xanh still offers two options: refunding the amount the customer has paid with a support interest rate of 10%/year or providing a voucher for a 20% discount on the value of the product at the project when the customer agrees to sign according to the new conditions.
With the voucher issuance plan, this time the document has a new point that the buyer is given an additional 5% discount and can transfer the right to use the discount to another person, but the discount for the transferee is 18%.

To enjoy this discount, customers must pay the full value of the apartment and will enjoy a discount in 3 stages: signing the sales contract and paying the first installment (5% discount), product handover notice (10% discount) and certificate handover notice (5% discount).
"We believe that these are reasonable and equitable solutions, and above all, they protect the legitimate interests of customers to the maximum extent," Dat Xanh informed.
Recently, Dat Xanh customers have sent collective petitions and appeals to many authorities, requesting to continue implementing commitments according to the signed principle contract or to amend the contract to balance the rights and legitimate interests of the parties after many years of waiting.
