The Government issued Resolution No. 66.2/2025/NQ-CP stipulating the handling of difficulties and obstacles in adjusting national planning, regional planning, and provincial planning when implementing the arrangement of administrative units and organization of two-level local governments during the period when the Law on Planning (amended) has not been promulgated.

This Resolution regulates the adjustment of national planning, regional planning, and provincial planning for the 2021-2030 period that has been decided or approved before July 1, 2025 when implementing the arrangement of administrative units and organization of two-level local governments during the period when the Law on Planning (amended) has not been promulgated.

Subject of planning adjustment

Subjects of planning adjustment include:

- National planning is affected by the arrangement of provincial administrative units and the organization of two-level local governments or to achieve the double-digit growth target for the period 2026-2030.

- Regional planning, including: the Northern midland and mountainous region; the Red River Delta region; the North Central region; the South Central Coast and Central Highlands region; the Southeast region and the Mekong Delta region;

- Planning of 34 provinces and centrally run cities after implementing the arrangement of provincial-level administrative units and organizing 2-level local governments or to achieve the double-digit growth target for the 2026-2030 period.

Regulations on planning adjustment

The Resolution stipulates that the planning task shall not be established, appraised, and approved for adjustment; the strategic environmental assessment report of the planning shall not be established or appraised; and the national master plan shall not be appraised or adjusted.

Procedures for preparing, appraising, deciding or approving planning adjustments for the 2021-2030 period

The Resolution stipulates the order of preparation and decision to adjust the national master plan as follows:

- The agency assigned to adjust the planning decides on the planning content that needs to be adjusted; develops a cost estimate for adjusting the planning based on the planning content that needs to be adjusted; organizes the appraisal and approval of the planning adjustment estimate according to the provisions of law; takes full responsibility before the law for the planning content that needs to be adjusted and the cost estimate for adjusting the planning;

- The agency assigned to make planning adjustments shall implement planning adjustments, complete planning adjustment dossiers, including: planning adjustment reports, draft planning adjustment decision documents, system of diagrams, maps, databases related to planning adjustment contents; send for comments to the Central Committee of the Vietnam Fatherland Front , ministries and provincial People's Committees;

- The agencies consulted are responsible for responding in writing within 10 days from the date of receipt of the request for comments;

- The agency assigned to prepare the planning adjustment shall receive, explain and complete the planning adjustment dossier according to the comments of the agencies, submit it to the Government for consideration and approval of the planning adjustment dossier before reporting to the National Assembly for consideration and decision.

The procedure for establishing, appraising and deciding on adjustments to national marine spatial planning is as follows:

- The agency assigned to make planning adjustments shall decide on the planning content that needs to be adjusted; develop a cost estimate for planning adjustments based on the planning content that needs to be adjusted; organize the appraisal and approval of the planning adjustment cost estimate according to current regulations of law; take full responsibility before the law for the planning content that needs to be adjusted and the cost estimate for planning adjustments;

- The agency assigned to make and adjust the planning shall make and adjust the national marine spatial planning according to current regulations of the law on planning, and send it to the Central Committee of the Vietnam Fatherland Front, ministries and provincial People's Committees for comments;

- The agencies consulted are responsible for responding in writing within 20 days from the date of receipt of the request for comments;

- The agency assigned to prepare the planning adjustment receives, explains and completes the dossier to adjust the national marine spatial planning according to the comments of the agencies;

- The agency assigned to prepare the planning adjustment shall review the content of the adjustment to the national marine spatial planning to ensure consistency with the adjustment to the national master plan for the 2021-2030 period decided by the National Assembly; submit for appraisal and approval according to the provisions of the Law on Planning (amended).

The procedure for preparing, appraising and approving adjustments to national sector planning is as follows:

- The agency organizing the planning adjustment shall decide on the planning content that needs to be adjusted; direct the agency assigned to prepare the planning adjustment to develop a cost estimate for the planning adjustment based on the planning content that needs to be adjusted; organize the appraisal and approval of the planning adjustment estimate according to current regulations of law; take full responsibility before the law for the planning content that needs to be adjusted and the cost estimate for the planning adjustment;

- The agency assigned to prepare and adjust the planning shall prepare and adjust the national sectoral planning according to current regulations of the law on planning, report to the planning organization and send it to the Central Committee of the Vietnam Fatherland Front, ministries and provincial People's Committees for comments;

- The agencies consulted are responsible for responding in writing within 20 days from the date of receipt of the request for comments;

- The agency assigned to prepare the planning adjustment receives, explains and completes the adjustment of the national sector planning according to the comments of the agencies;

- The agency assigned to prepare and adjust the planning shall review the content of the national sectoral planning adjustment to ensure it is consistent with the adjustment of the national master plan for the 2021-2030 period decided by the National Assembly; report to the planning agency before submitting it for appraisal and approval according to the provisions of the Law on Planning (amended).

- The agency assigned to adjust the planning decides on the planning content that needs to be adjusted; develops a cost estimate for adjusting the planning based on the planning content that needs to be adjusted; organizes the appraisal and approval of the cost estimate for making and adjusting the planning according to current regulations of law; takes full responsibility before the law for the planning content that needs to be adjusted and the cost estimate for adjusting the planning;

- The agency assigned to prepare and adjust the planning shall prepare and adjust the regional planning according to current regulations of the law on planning, and send it to the Central Committee of the Vietnam Fatherland Front, ministries and provincial People's Committees in the region for comments;

- The agencies consulted are responsible for responding in writing within 20 days from the date of receipt of the request for comments;

- The agency assigned to prepare the planning adjustment receives, explains and completes the regional planning adjustment according to the comments of the agencies;

- The agency assigned to prepare and adjust regional planning shall review the content of the regional planning adjustment to ensure it is consistent with the adjustment of the national master plan for the 2021-2030 period decided by the National Assembly; submit it for appraisal and approval according to the provisions of the Law on Planning (amended).

The procedure for preparing, appraising and approving adjustments to provincial planning is as follows:

- The agency organizing the planning adjustment decides on the planning content that needs to be adjusted; directs the agency assigned to prepare the planning adjustment to develop a cost estimate for the planning adjustment based on the planning content that needs to be adjusted; organizes the appraisal and approval of the planning adjustment estimate according to the provisions of law; takes full responsibility before the law for the planning content that needs to be adjusted and the cost estimate for the planning adjustment;

- The agency assigned to prepare and adjust the planning shall prepare and adjust the provincial planning according to current regulations of the law on planning, report to the planning organization and send it to the ministries, People's Committees of adjacent provinces and the Provincial Fatherland Front Committee for comments;

- The agencies consulted are responsible for responding in writing within 20 days from the date of receipt of the request for comments;

- The agency assigned to prepare the planning adjustment receives, explains and completes the provincial planning adjustment according to the comments of the agencies;

- The agency assigned to prepare the planning adjustment shall review the content of the provincial planning adjustment to ensure it is consistent with the adjustment of the national master plan for the 2021-2030 period decided by the National Assembly; report to the planning organization before submitting for appraisal and approval of the provincial planning adjustment according to the provisions of the Law on Planning (amended)./.
