7 wasteful behaviors that need to be focused on and prevented

Seven wasteful behaviors that need to be focused on for prevention and control include: violations in leadership, direction, management, and use of public finance and public assets, causing waste; causing waste related to the construction and promulgation of institutions on management and use of public finance and public assets; causing waste in management and use of the state budget;

Causing waste in management and use of public investment capital; construction investment, procurement, management and use of public assets; causing waste in management, exploitation and use of land and other resources; causing waste in management and use of state capital in investment projects under the public-private partnership (PPP) method; state capital in enterprises.

There are also other acts of waste in the management and use of public finance and public assets according to Party regulations and State laws.

The Central Steering Committee directly monitors and directs the handling of cases and incidents: Involving many central departments, ministries, branches, agencies; provinces and centrally-run cities; causing serious, very serious or especially serious consequences.

Second, related to senior leaders of the Party, State and Vietnam Fatherland Front; officials under the management of the Politburo and Secretariat.

Third, there are signs of law violations during the process of inspection, examination, auditing, and prosecution that may distort the results of investigation, prosecution, trial, and handling of cases; cases causing waste that have had legally effective judgments and decisions but have complaints, denunciations, recommendations, and requests for reconsideration, causing public outrage.

Fourth, other serious and complicated cases and incidents of waste that the Central Steering Committee and the Standing Committee of the Central Steering Committee deem necessary to directly monitor and direct.

The provincial and municipal Steering Committees for Anti-Corruption, Wastefulness and Negativity monitor and direct the handling of complicated cases and incidents causing waste that are of public concern in the locality; and involve leaders and managers under the management of the provincial and municipal Party Committees.

Serious and complicated cases and incidents of waste that are of public concern are assigned by the Central Steering Committee or the Standing Committee of the Central Steering Committee or are requested by competent authorities at the central level for the provincial Party Committee, city Party Committee, and provincial Steering Committee to direct and handle.

Other wasteful cases and incidents that are of public concern and which local prosecution agencies have different views on; wasteful cases that have had legally effective judgments and decisions but have had complaints, denunciations, recommendations, and requests for reconsideration and are of public concern.

Cases considered for exclusion, exemption, or reduction of liability

Organizations and individuals who commit violations and cause waste as stated in the guidelines must be held accountable, strictly handled and compensated according to Party regulations, State laws and regulations of agencies, organizations, units and enterprises with state capital.

In case of violation to the extent that criminal liability must be prosecuted, the case must be transferred to the competent authority for handling according to the provisions of law. It is strictly forbidden to retain it for internal handling.

Organizations and individuals who commit violations and cause waste due to objective reasons (violations in urgent situations, unexpected events or due to objective obstacles as prescribed by law) or have proactively detected and applied necessary measures within their authority or reported to competent authorities to prevent, handle and remedy the consequences of violations in accordance with orders and decisions of superiors, without knowing that such decisions and orders are illegal, shall be considered for exclusion, exemption or reduction of responsibility according to Party regulations and State laws.
