The Ministry of Education and Training has just posted and solicited opinions on a draft circular regulating rewards and discipline for students, in which the most severe form of discipline, expulsion, is abolished for students who violate the law.
The new Circular, when issued, will replace Circular 08/TT of the Ministry of Education and Training guiding the rewards and discipline of students in general schools from nearly 40 years ago (1988).

The current circular has 5 forms of discipline for students depending on the level of violation: reprimand in front of the class, reprimand in front of the school's disciplinary council, warning in front of the whole school, 1-week expulsion and 1-year expulsion.
The new draft circular is completely revised, with only three forms of discipline remaining: warning, criticism, and requiring students to write a self-criticism; there is no longer the form of expulsion for students.
One of the contents that has been strongly criticized in the regulations on student discipline in Circular 08/TT guiding the rewards and discipline of students in current general schools is the criticism in front of the class or the whole school when students make mistakes (depending on the level). The draft circular regulating rewards and discipline for general school students has abolished this regulation.
The draft stipulates two disciplinary measures for primary school students: warning and request for apology. Disciplinary measures for primary school students do not keep records and student records. At the same time, it stipulates forms of rewards including commendation in front of the class, commendation in front of the whole school, certificates of merit from the principal and letters of commendation.
In addition to the forms of commendation and reward, agencies, organizations and individuals can implement other appropriate forms of commendation and reward to promptly encourage and set an example for students in their studies and training.
It was planned to replace "expulsion" with "suspension of study"
Previously, in 2020, the Ministry of Education and Training announced a draft of a new circular regulating rewards and discipline for high school students, expected to replace Circular 08/TT, which is considered outdated.
The draft circular being consulted at this time also abolishes the disciplinary form of expulsion for students but still maintains the disciplinary level of "temporary suspension from studying", applied to cases where students have been disciplined with a warning but do not correct their mistakes, re-offend or commit other violations within a period of 1 semester...
For other violations, teachers and schools can choose to apply a number of measures to positively discipline each student: advise, encourage; remind, and criticize students with shortcomings.
However, after receiving many mixed opinions, the Ministry of Education and Training has not issued the circular so far.
According to the representative of the Department of Students (Ministry of Education and Training), disciplinary measures aim to prevent, stop and handle student violations. Discipline aims to educate and help students to be aware of their violations; to voluntarily adjust their behavior, overcome consequences, voluntarily cultivate and practice to improve and form disciplined habits and lifestyles.
The principles of discipline aim to ensure students' initiative and positivity in exercising their rights, obligations and responsibilities; maintain discipline and order in the school. Respect, tolerance, objectivity, no prejudice, ensure students' right to participate and benefits in related issues.
Ensure that the discipline is appropriate to the psychological, gender, physical, family background, and regional cultural characteristics of each student. Do not use disciplinary measures that are violent, insulting to dignity, or that affect the physical and mental health of students.
