1. Subjects of compulsory motorbike insurance

The subject of compulsory civil liability insurance of motor vehicle owners (compulsory motorbike insurance) is the civil liability of motor vehicle owners towards third parties and passengers as prescribed by law.

(Article 5 of Decree 67/2023/ND-CP)

2. Limits of liability of compulsory motorcycle insurance

The liability limit of compulsory motorbike insurance is stipulated in Article 5 of Decree 67/2023/ND-CP as follows:

- The insurance liability limit for damage to health and life caused by motor vehicles is 150 million VND per person in an accident.

- Limit of liability for property damage:

+ Caused by two-wheeled motorbikes; three-wheeled motorbikes; motorbikes (including electric motorbikes) and vehicles with similar structures as prescribed by the Law on Road Traffic is 50 million VND per accident.

+ Caused by cars; tractors; trailers or semi-trailers pulled by cars or tractors as prescribed by the Road Traffic Law is 100 million VND in one accident.

3. Compulsory motorcycle insurance premium 2023

The compulsory motorbike insurance premiums for 2023 are specified in Appendix I issued with Decree 67/2023/ND-CP as follows:

Based on the insurance claim history of each motor vehicle or the accident history of the motor vehicle owner, the insurance company will proactively consider and adjust the insurance premium up or down. The maximum increase or decrease in insurance premium is 15% calculated on the above insurance premium.

4. Cases where compulsory motorcycle insurance is not available for compensation

Insurance companies are not responsible for insurance compensation in the following cases:

- Intentional acts causing damage by the motor vehicle owner, driver or injured person.

- The driver who caused the accident intentionally fled and did not fulfill the civil liability of the motor vehicle owner. In case the driver who caused the accident intentionally fled but has fulfilled the civil liability of the motor vehicle owner, it is not a case of insurance liability exclusion.

- The driver does not meet the age requirements as prescribed by the Law on Road Traffic; the driver does not have a driving license or uses an invalid driving license as prescribed by law on training, testing, and granting of driving licenses for road motor vehicles; the driving license is erased or uses an expired driving license at the time of the accident or uses an inappropriate driving license for a motor vehicle that requires a driving license. In case the driver has his/her driving license revoked or has his/her driving license revoked, he/she is considered to have no driving license.

- Damage causing indirect consequences includes: reduction in commercial value, damage associated with the use and exploitation of damaged assets.

- Damage to property caused by driving a motor vehicle with a blood or breath alcohol concentration exceeding the normal value according to the instructions of the Ministry of Health ; using drugs and stimulants prohibited by law.

- Damage to property stolen or robbed in the accident.

- Damage to special assets including: gold, silver, precious stones, valuable papers such as money, antiques, rare paintings, corpses, and remains.

- Damage caused by war, terrorism, earthquake.

5. Can use electronic version of compulsory motorbike insurance

Article 10 of Decree 67/2023/ND-CP, when purchasing compulsory civil liability insurance for motor vehicle owners, the motor vehicle owner is issued an Insurance Certificate by the insurance company. Each motor vehicle is issued 1 Insurance Certificate.

In case of issuing an electronic Insurance Certificate, the insurance enterprise must comply with the provisions of the Law on Electronic Transactions and its implementing guidelines; The electronic Insurance Certificate must fully comply with current regulations and fully reflect the contents as prescribed in Clause 3, Article 10 of Decree 67/2023/ND-CP.

Thus, people can use electronic compulsory motorbike insurance.

6. Compulsory motorcycle insurance claim file

The compulsory civil liability insurance claim file of motor vehicle owners includes the following documents:

(1) Claim document.

(2) Documents related to the motor vehicle and driver (Certified copy of the original or Copy certified by the insurance company after comparison with the original or photocopied copy):

- Vehicle registration certificate (or a certified copy of the original Vehicle registration certificate with the original valid Receipt from the credit institution, in lieu of the original Vehicle registration certificate during the period the credit institution holds the original Vehicle registration certificate) or vehicle ownership transfer documents and vehicle origin documents (in case there is no Vehicle registration certificate).

- Driving license.

- Identity card or Citizen Identification card or Passport or other identification documents of the driver.

- Insurance certificate.

(3) Documents proving damage to health and life (Copies from medical facilities or copies certified by the insurance company after comparison with the original or photocopies). Depending on the extent of damage to people, one or more of the following documents may be included:

- Certificate of injury.

- Medical records.

- Extract of death certificate or Death certificate or confirmation document of the police agency or forensic examination result of the forensic examination agency in case the victim died in a vehicle or died in an accident.

(4) Documents proving damage to property:

- Valid invoices, documents or evidence proving the repair or replacement of damaged property caused by the accident (in case the insurance company carries out repairs or damages, the insurance company is responsible for collecting these documents).

- Documents, invoices, and vouchers related to the costs incurred by the motor vehicle owner to minimize losses or to follow the instructions of the insurance company.

(5) Copies of relevant documents of the police agency in accidents causing death to third parties and passengers or in cases where it is necessary to verify that the accident was caused entirely by the fault of the third party, including: Notice of investigation results, verification, and settlement of the accident or Notice of conclusion of investigation and settlement of the accident.

(6) Minutes of assessment by the insurance company or the person authorized by the insurance company.

(7) Court decision (if any).

The policyholder and the insured are responsible for collecting and sending documents 1, 2, 3, 4, 7 to the insurance company. The insurance company is responsible for collecting documents 5, 6.
