Party Secretary Tran Luu Quang discussed the proposal for an 'exception' regulation when people subdivide inherited land.

Ho Chi Minh City Party Secretary Tran Luu Quang acknowledged that the spontaneous subdivision and parcelling of land is wrong, but he appreciated the existence of a council to review special cases, similar to what Binh Duong (formerly) did.

On the morning of December 16th, Ho Chi Minh City Party Secretary Tran Luu Quang, along with delegates from Group 12 of the Ho Chi Minh City National Assembly Delegation, met with constituents following the 10th session of the 15th National Assembly in Dong Hoa ward (formerly Binh Duong province ).

During the meeting, voters from the two wards of Dĩ An and Đông Hòa expressed many opinions on issues related to people's lives and social welfare.

In particular, delegates were interested in the organization of a two-tiered local government system and resolving obstacles related to projects...

Speaking afterward, Secretary Tran Luu Quang acknowledged the opinions of all voters and promised to responsibly forward these opinions to the relevant authorities that can provide appropriate answers.

"As National Assembly representatives and Party Secretary of the City Committee, we must fulfill our promises. Therefore, we want to state upfront that we make promises very carefully, only promising things that fall within our responsibilities and only promising things we can actually do," Mr. Quang emphasized.

Mr. Quang assessed Di An and Dong Hoa wards as two special wards, and also praised the voters' opinions as very insightful and relevant to real life. Some people could speak without needing notes, demonstrating that the people are very concerned about the government and the National Assembly, and have a constructive spirit, wanting things to improve.

In addition to explaining and directing the resolution of specific issues raised by voters related to people's livelihoods, the Secretary of the Ho Chi Minh City Party Committee paid attention to voters' opinions requesting a "special mechanism" for land subdivision in some cases where people have long-term land ownership and want to divide it for their children.

Voter Tran Thi Quynh Mai (Di An ward) said that recently, people have been concerned about the issue of land subdivision. Parents and grandparents leave land to their children and grandchildren, but the Land Law, when implemented, requires that any land to be divided among descendants must include an area for access roads.

"Regarding access roads, there are two cases: one is land subdivision within a planned area, and the other is family-inherited land. Does this fall under the category of land subdivision? This is difficult for the family," Ms. Mai said, suggesting an exception so that land inherited from grandparents can be subdivided as long as there is an internal access road.

Regarding this issue, Party Secretary Tran Luu Quang said: "The spontaneous subdivision of land is wrong, but if we don't accept this, the people will suffer greatly. However, we are resolving it according to regulations, reviewing everything systematically and fairly with everyone else, and then addressing outstanding issues such as whether or not land has been subdivided."

Mr. Quang said that exceptional cases include land subdivision during valuation, land splitting based on inheritance, and the requirement for a beautiful urban environment to meet standards and have proper roads…

Nevertheless, he appreciated that Binh Duong province previously had a special review council, because the law is universal and therefore cannot be applied to all cases; there are exceptions. Councils like this are very necessary.

"The regulations apply nationwide, but there are cases where they don't fit into the city's regulations, so we've requested special mechanisms. Previously, only Ho Chi Minh City had these regulations, but now Binh Duong and Vung Tau have joined, leading to certain discrepancies in policies and procedures in the work of these localities," Mr. Quang said.

Previously, Mr. Vo Trong Tai - Chairman of the People's Committee of Dong Hoa Ward - stated that in 2024, the People's Committee of Binh Duong Province (formerly) issued a decision to establish a special council to consider subdividing land plots that did not meet the necessary conditions.

This decision addressed the needs of the people, but after the merger, there was no guidance on its continued implementation, leading to many households wanting to subdivide their land but being unable to do so.

Upon hearing this, Secretary Tran Luu Quang suggested that the leaders of the Department of Agriculture and Environment study Binh Duong's decision. If it cannot yet be implemented throughout the new Ho Chi Minh City, they should reinstate Binh Duong's decision. Applying it to the entire Ho Chi Minh City would be very beneficial.

Mr. Quang suggested that the National Assembly Representative Office forward this information to the Department of Natural Resources and Environment to propose the issuance of a mechanism similar to the one previously used in Binh Duong.

Speaking about the organizational structure after the merger, Secretary Tran Luu Quang said: "Voters strongly support the new methods and much simpler procedures, and I am grateful for that. However, there are still many things I haven't worked on yet, so I have to keep a record of many outstanding issues."

According to Mr. Quang, the central government's guidelines on cities are incomplete and not timely.

He gave an example: "Some localities issue land use right certificates via phone, requiring only the final visit to the one-stop service center to receive the certificate. However, this is difficult because the computers are of different generations, some work, some freeze; the internet connection is sometimes open, sometimes closed; and some staff members are skilled at typing, while others are not."

Nevertheless, Mr. Quang expressed: "I believe it will be delicious in the future."
